Description

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and a written solicitation will not be issued. Request for Quotation (RFQ) E002443 is assigned to this solicitation and shall be referenced on any quotation. All incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-08. The NAICS code is 541519 with a business standard of $21.0 million. This solicitation is being conducted under the Simplified Acquisition Procedures (SAP). This solicitation will be distributed solely through the General Services Administration?s Federal Business Opportunities web site http://fedbizopps.gov/. The site provides downloading instructions. All future information about this acquisition including solicitation amendments, will also be distributed solely through this site. Interested parties are responsible for monitoring this site to ensure that they have the most up-to-date information about this acquisition. This contract will result in a Firm Fixed Price Contract. The Government intends to procure on a sole source basis for continuing software support for Etherpeek software from Wildpackets, Inc., Walnut Creek, CA 94596. Wildpackets Inc. is the manufacturer of the Etherpeek software. The proposed contract action is for software support for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1. Interested persons may identify their interest and capability to respond to the requirement. FOB Destination, FBI, ERF Bldg., #27958A, Quantico, VA 22135. This is not a request for competitive quotes, however, all compliant quotes received within five (5) days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete this proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received from other than the requested party will be considered solely for the purpose of determining whether to conduct a competitive procurement. The following clauses and provisions are incorporated by reference and apply to the acquisition: FAR 52.212-1 Instructions to Offer-Commercial Item (Jan 2005); FAR 52.214-4 Contract Terms and Conditions-Commercial Items (Oct 2003); FAR 52.212.5 Contract Terms and Conditions Required to Implement Statutes or Executive Order-Commercial Items (Jan 2005); FAR 52.215-5 Facsimile Proposals (Oct 1997); PROTEST AFTER AWARD (Aug 1996); The Department of Justice (DOJ) Justice Acquisition Regulation Clauses, 2852.233-70 PROTESTS FILED DIRECTLY WITH THE DEPARTMENT OF JUSTICE (Jan 1998), Subsection (a), (b), (d), and (e) apply.
