- Combined Synopsis / solicitation This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Please refer to Request for Proposal Number: W91GXZ-06-Q-0003. The provisions and clauses incorporated are those in effect through Federal Acquisition Circular FAC: 2005-06, effective 31 October 2005 & Class Deviation 2005-o0001; DFARS: DCN 20051220. The requirement is an open market solicitation for NAICS Code: 811310; Size Standard: <1,000,000 Closing date is 20 January 2006, 1700 hrs Baghdad, Iraq time. Project Intent 2.1 The intent of the Project Base Contract is for the contractor to engineer, design, procure, install and commission all systems related to providing generator power to the NELCON Cranes; located at the Umm Qasr South Port. The contractor shall utilize any and all of the onsite Government Furnished Equipment (GFE), which is summarized in this Scope of Work. 2.2 The intent of the Project Contract Option AA is for the contractor to engineer, design, procure, install and commission all systems related to providing normal utility power from the Iraqi National Grid system (originating from Substation #8) to the NELCON Cranes. The Contracting Officer reserves the right to exercise Contract Option AA within 60 days following contract award. 2.3 The contractor shall be fully responsible to engineer and design a functional system. Contractor shall be responsible for reviewing the scope of work, evaluating site, assessing the GFE for functionality and procuring any additional / replacement parts or equipment required to provide a fully functional system. Any additional equipment and material requirements deemed necessary by the contractor’s design is the responsibility of the contractor to supply and install. 2.4 All GFE is currently staged at within various warehouses at the Umm Qasr North Port. To every extent possible, the contractor shall utilize the GFE in order to minimize the time for material acquisition and to reduce contract cost. All GFE shall be considered serviceable unless otherwise stated in the Scope of Work. FAR and DFARS Clauses and Provisions: 52.212-1, Instruction to Offerors; 52.212-2, Evaluation -- Commercial Items (The Government will award a contract resulting from this solicitation to the responsible offeror whose offer is the best value to the Government. The following factors shall be used to evaluate offers: 1) Technically acceptable, which is greater than 2) Past Performance of which is equal to 3) price. The contract award will be based on Low price, Technically Acceptable. Options: The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to accept the option(s). A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award; 52.212-3, Offeror Representations and Certifications - Commercial Items; 52.212-4, Contract Terms and Conditions - Commercial Items; 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items, including 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52,232-33, 52.232-36 and 52.225-13; 252.204-7004 Alt A, Required Central Contractor Registration; 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items, including 252.225-7001.
