- This notice is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. While the solicitation is not export-controlled, the end item to which it pertains is export-controlled; therefore, offers will only be accepted from those offerors who qualify and certify as a U.S. person in accordance with 22 CFR 120.15 of the International Traffic at Arms Regulations (ITAR). This notice is being issued as a Request for Proposal (RFP) for a Firm Fixed Price Contract for 1 EA Robotic Friction Stir Welding System, including all training and travel, to be engineered, designed, fabricated, delivered, installed, and accepted at Marshall Space Flight Center (MSFC) within 13 months from contract award with four options which must be exercised within the first 12 months period after contract award as follows (if exercised): (1) 1 EA Panel Welder to be delivered within 6 months after option exercise; (2) 1 EA Platform to be delivered within 4 months after exercise; (3) 1 EA Seam Scanner/Tracker to be delivered within 6 months after exercise; and (4) a second Robotic Friction Stir Welding System to be delivered to Michoud Assembly Facility (MAF), New Orleans, LA, within 13 months after exercise. All offerors must purchase a license from The Welding Institute (TWI) to use Friction Stir Welding Technology in accordance with paragraph 3.1 of the Performance Work Statement. Please note that previous information provided in Presolicitation Synopsis No. NNM06ZPS001 was for preliminary information only. In particular, please take note that the requirement for offerors to obtain a license to utilize NASA's patent on the auto-adjustable pin-tool technology from specific identified contractors who possess exclusive licenses with NASA has been removed. Since NASA owns the patent for this technology, it will be made available to the awardee under the Government's usage license. The provisions and clauses in the RFP are those in effect through FAC 05-08. The NAICS Code and the small business size standard for this procurement are 333992 and 500, respectively. The offeror shall state in their offer their size status for this procurement. All responsible sources may submit an offer which shall be considered by the agency. Delivery, installation and acceptance shall be to Marshall Space Flight Center for the base system and the 3 enhancement options and to MAF, New Orleans, LA, for the 2nd system if option is exercised, in accordance with the schedule outlined above. Delivery shall be FOB Destination. The DPAS rating for this procurement is DO-C9. Offers for the items described above are due by 4:30 p.m., May 5, 2006, to Janice Burrough, PS22, George C. Marshall Space Flight Center, Marshall Space Flight Center, AL 35812, Bldg 4600, Room 4124, in accordance with the Instructions to Offerors included herewith and must be signed by an authorized company representative. Offerors shall provide the information required by FAR 52.212-1 (JAN 2005), Instructions to Offerors-Commercial, which is incorporated by reference. Addenda to FAR 52.212-1 are as follows: Additional Instructions to Offerors are included herewith. FAR 52.212-4 (OCT 2003), Contract Terms and Conditions-Commercial Items is applicable. Addenda to FAR 52.212-4 are as follows: 52.204-4, 52.204-7, 52.211-15, 52.245-2, and 52.247-34. FAR 52.212-5 (FEB 2006), Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items is applicable and the following identified clauses are incorporated by reference: 52.203-6, 52.219-8, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222.37, 52.222-39, 52.225-13, and 52.232-33. The FAR may be obtained via the Internet at URL: http://www.arnet.gov/far/ The NFS may be obtained via the Internet at URL: http://www.hq.nasa.gov/office/procurement/regs/nfstoc.htm OTHER TERMS AND CONDITIONS: 52.217-9, 52.232-18 (AVAILABILITY OF FUNDS), 1852.215-84, 1852.223-72, 1852.237-73, 1852.246-72, and Safety and Health clause incorporating DRD STD/SA-SHEWA and contractor's signed work agreement confirming his commitment to comply with OSHA and DOT regulations and to use MSFC MPR 8715.1 as the contractor's safety program while on-site. All contractual and technical questions must be in writing (e-mail or fax) to Janice Burrough/PS22 not later than April 21, 2006. Telephone questions will not be accepted. Selection and award will be in accordance with the evaluation factors in the Evaluation Criteria document uploaded herewith. In addition, this document provides the relevant importance of factors and relationship to price. A Model Contract is attached herewith so that the Government may go straight to award without discussions if appropriate. Offerors shall complete items required on SF 1449 of the Model Contract, to include blocks 12, 17a, 26, 30b, and 30c and blocks 11 and 17b if applicable (pdf. file). In addition, offeror shall complete the unit price and amount (labeled blocks 23 and 24) on page 2 for each line item (word file). The proposed amount for the Robotic Friction Stir Welding System for both the base and the option units has been divided into five separate deliverables as indicated on the attached Model Contract for payment purposes (page 2, word file). The offeror shall calculate the identified percentages based on his total proposed amount of the applicable (base or option 4) Friction Stir Welding System. In addition, the offeror shall enter the total amount for that system in Block 20 in the blank provided for that purpose. Each offeror shall provide three completed copies with original signatures in block 30a and two additional copies of the SF 1449 of the Model Contract with his offer. The SF 1449 attached is a pdf. file and cannot be changed electronically. Offerors should enter info required above in the pdf. file before signing copies. Offerors shall use only page 1 (SF 1449) of the pdf. file. Pages 2-12 and attachments are located in the word document identified as the Model Contract. In addition, Offerors must include completed copies of the provisions included entitled Representation, Certifications and Other Statement of Offerors with their offer. These representations and certifications will be incorporated by reference in any resultant contract. An ombudsman has been appointed -- See NASA Specific Note "B". Prospective offerors shall notify this office of their intent to submit an offer.
