Description
The Government is planning to establish multiple, unpriced Blanket Purchase Agreements (BPA???s), not contracts, for Landscaping Services to be performed at Picatinny Arsenal, New Jersey, 07806. Additional information on BPA???s is at FAR 13.303. BPA???s will be issued in advance of actual requirements in order to set forth the terms and conditions that will be applicable to purchases made under each BPA, aka ???Calls.??? Upon issuance of a BPA, the Government will be obligated only to the extent of authorized purchases actually made under the BPA. Each established BPA will be for a duration of five years, subsequent to review at least annually and updated, if necessary, at that time. Competition for individual calls may be limited to BPA???s established subsequent to this announcement, if deemed by the Contracting Officer to represent the maximum practicable competition. The SOW is available for downloading at the website for the issuing office http://procnet.pica.army.mil, also referred to as Procnet. The Government plans to establish BPAs with the following vendors that responded to the market survey: Bednar Landscaping Services, Boonton, NJ 07005; Andy-Matt, Inc., Mine Hill, NJ 07803; TM Landscape, Mine Hill, NJ 07803. The Contracting Officer will consider additional sources that wish to be considered for a BPA and submit the required information as stated herein. i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; Specific documentation is being requested for the Government???s assessment of vendor capability to satisfy landscaping requirements at Picatinny under BPA???s; a written solicitation will not be issued. This is not to be construed as a commitment by the Government. All information is to be submitted at no cost to the Government. (ii) This announcement constitutes solicitation number W15QKN-06-R-0738, issued as a request for unpriced proposal (RFP). (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-07, 2 February 2006. FACs issued prior to award will be incorporated in awards resulting from this solicitation. (iv) This is a total set-aside for Small Business firms, the associated NAICS code is 561730 and small business size standard is $6.5 Million in annual average receipts over the last three years. (v) Contract line item number(s) and items, quantities and units of measure, as applicable, will be as stated in each call. (vi) Examples of the items or services to be acquired under the resultant BPA???s can be reviewed and downloaded at Procnet, under the RFP number. (vii) Term of service and delivery dates as applicable will be as stated in each call. Place of performance and/or place of delivery and acceptance and FOB point for all calls will be Picatinny Arsenal, NJ. (viii) The provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition and any agreed upon addenda to the provision will be included in the resultant BPAs. (ix) Multiple BPA???s will be established with qualified vendors based on the Government???s assessment of each vendor???s capability to satisfy the Government???s requirements, based on information submitted in response to the Sources Sought Notice (Reference W15QKN-06-X-0734) and this announcement. (x) To be considered for a BPA, vendors must submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, available for downloading at Procnet. (xi) The clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition and any agreed upon addenda to the clause will be incorporated in the BPA. (xii) The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items, applies to this acquisition and the following additional FAR clauses cited in the clause are applicable: 52.219-8, Utilization of Small Business Concerns (MAY 2004) (15 U.S.C. 637(d)(2) and (3)), in all subcontracts that offer further subcontracting opportunities. 52.222-26, Equal Opportunity (Apr 2002) (E.O. 11246). 52.222-35, Equal Opportunity for Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans (Dec 2001) (38 U.S.C. 4212). 52.222-36, Affirmative Action for Workers with Disabilities (Jun 1998) (29 U.S.C. 793). 52.222-39, Notification of Employee Rights Concerning Payment of Union Dues or Fees (DEC 2004) (E.O. 13201). 52.222-41, Service Contract Act of 1965, as Amended (JUL 2005), flow down required for all subcontracts subject to the Service Contract Act of 1965 (41 U.S.C. 351, et seq.). 52.247-64, Preference for Privately Owned U.S.-Flag Commercial Vessels (Apr 2003) (46 U.S.C. Appx 1241 and 10 U.S.C. 2631). Flow down required in accordance with paragraph (d) of FAR clause 52.247-64. (xiii) One or more site visits will be conducted after establishment of BPA???s and prior to issuance of a call, at the Government's discretion. (xiv) Each BPA will include as a minimum, terms and conditions mandated by Federal Acquisition Regulations (FAR) and the Department of Defense FAR Supplement (DFARS) for commercial item acquisitions, set aside for small business firms, including the following: FAR 52.219-6, Notice of Total Small Business Set-Aside, FAR 52.22-3 Convict Labor (E.O. 11755); FAR 52.222-21, Prohibition of Segregated Facilities; FAR 52.222-26, Equal Opportunity (E.O. 11246); FAR 52.222-35, Equal Opportunity for Special Disabled Veterans, Veterans of the Vietnam Era and other Eligible Veterans (38 U.S.C. 4212); FAR 52.222-36 Affirmative Action for Workers with Disabilities (29 U.S.C. 793); FAR 52.222-37, Employment Reports on Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans (38 U.S.C. 4212); FAR 52.232-33, Payment by Electronic Funds Transfer. Full-text clauses can be viewed online at http://www.arnet.gov/. (xv) Vendors must be willing to comply with the following: a. Register online at http://www.bpn.gov/. Registration is particularly important for Electronic Funds Transfer payment purposes. Additional information is available at the website. b. Submit payment requests in electronic form as required by the DFARS clause 252.232-7003, except for individual cases where--(i) The contractor is unable to submit, or DoD is unable to receive, a payment request in electronic form; and (ii) The contracting officer, the payment office, the contract administration office, and the contractor mutually agree to an alternative method. c. Comply with the requirements of the ARDEC 68 clause, which is available for review and downloading at Procnet. If interested, submit company and/or product literature or other written description of the services available, in sufficient detail for Government personnel to assess your capability to satisfy its general landscaping requirements; any discount terms offered; a copy of any terms and conditions customarily included in your commercial contracts to include any express warranty. In addition, provide your company name and address, point of contact with telephone number and email address, and size of business. BPA???s may be issued based on the information received as a result of the market survey posted February 28, 2006, this synopsis/solicitation or from other sources without further announcement or solicitation. Resultant BPA???s will be subject to the Service Contract Act. Wage Determination No. 94-2353, Revision 21, 3 June 2005, is applicable. Future revisions will be incorporated if and when required. (xvi) To be considered for a BPA, vendors not identified herein must submit the required information not later than 3:00 PM EDST on the closing date stated herein, to the Contracting Officer via email or at the following address: Commander, U.S. Army TACOM-Picatinny, ATTN: AMSTA-AQ-APG (S.
