- Amendment 2- Part 2 Statement of Work 5.1.5 SECURITY CLEARANCE REQUIREMENTS- None. 6. PERIOD OF PERFORMANCE- Contract award is for a base period (date of contract award through 9/30/06) with four (4) one year option periods. 7. UNSUITABLE PERSONNEL. BEP reserves the right of removal from any and all contract work any MRO personnel that the BEP has found to be unsuitable. The MRO shall remove the unacceptable personnel immediately after receiving a written notice from the Contracting Officer. 8. TRAVEL. The Government will reimburse the MRO for the actual cost of travel and travel-related miscellaneous expenses. Reimbursements, to include per diem, shall not exceed the rate and conditions of reimbursement set forth in the Federal Travel Regulations. All travel associated with the performance of this contract that is not directed by the Government must be approved by the COTR in advance. The MRO shall submit the travel justification, including itinerary for travel to the COTR for approval within twenty (20) working days, prior to the anticipated travel. In the event the MRO is required to travel to provide testimony at an administrative proceeding, 20 days advance notice may not be practicable. 9. ACCESS TO BEP FACILITIES. None anticipated. However, the BEP reserves the right to deny access to its facilities and/or security systems in accordance with adjudicative guidelines set forth in Executive Order 10450 and applicable supplemental directives, to an individual about which an adverse suitability determination is made. Failure to submit the required security investigation packet or to truthfully answer all questions contained in security investigation packets shall constitute grounds for denial of access clearance. The selected MRO shall not provide access to employees, or subcontract employees, until written access clearance is provided by the Personnel Security Division. MROs and Sub-MROs are responsible for reporting all changes concerning any of their employees, which may affect the suitability of their employees for access to the BEP or placement in any of these positions including additions or deletions. Notification must be provided to the COTR within five (5) days of awareness of the occurrence or the change. a. The MRO shall give the COTR 48-hour prior notice, including the full name, Social Security Number, company affiliation plus date and time of intended visit for all MRO personnel visiting BEP on an intermittent basis. b. MRO personnel requiring access to BEP on a recurring basis will be issued ?MRO? access badges. The COTR will provide the appropriate forms (an 85P-High Risk Packet) to the MRO for all MRO personnel requiring recurring access to the BEP. These forms must be completed and submitted for approval at least 40 days in advance of the first expected visit. 10. PERFORMANCE REQUIREMENTS. In order to provide the support needed for the Bureau, the MRO must: a. Produce the contractual Deliverables in conformance with the cited Directives and contract terms. b. Complete the contractual Deliverables by the scheduled/agreed upon date. 11. PERFORMANCE STANDARDS. a. All of the contractual Deliverables and Documents must conform to the requirements set forth in the contract Directives. b. All of the contractual Deliverables and Documents must be completed on time. 12. QUALITY ASSURANCE. a. Quality Assurance: 1). The MRO shall develop and submit a quality assurance plan that shows the extent to which the MRO provides thorough operating plans and procedures to include proper security, records maintenance, chain of custody, etc. and that show the extent to which the MRO provides quality control procedures that are effective and complete in order to detect and correct deficiencies, to ensure contract compliance. The MRO may rely on their existing quality assurance system, provided that it ensures contract compliance. Copies of the MRO?s quality control program shall be provided to the COTR on the contract start date and as changes occur. The program should include: 1.a. An inspection system covering the services stated in the Contract and Performance Requirements Summary. It must specify areas to be inspected on both a scheduled or unscheduled basis and the title of the individual who will do the inspection. 1.b. A method for identifying deficiencies in the quality of services performed before the level of performance is unacceptable. 1.c. A file of all inspections conducted by the MRO and the corrective action taken. This documentation will be made available to the COTR upon request. 2). The Government will survey the MRO?s quality and timeliness by periodic review of MRO records and other documentation. b. Acceptable Quality Level (AQL): 1). The Government assumes that all (100 percent) of the deliverables will meet contract requirements. a. Calculation: 1). Quality of Deliverables: Producing Deliverables that meet SOW requirements and require no rework will result in full payment of contract price. If any Deliverables requires rework, however fifty (50) percent of total price of applicable deliverable) will be deducted, excluding travel costs. 3). Timeliness: Producing all Deliverables by the required dates will result in full payment of contract price. If the MRO fails to produce all Deliverables by the required schedule dates, fifty (50) percent of the price of each applicable deliverable will be deducted, excluding travel costs. 13.0 PERFORMANCE REQUIREMENTS SUMMARY REQUIRED SERVICE (Performance Requirements) STANDARD (Performance Standards) MAXIMUM ALLOWABLE DEGREE OF DEVIATION (AQL) METHOD OF SURVEILLANCE (Quality Assurance) MAXIMUM PAYMENT PERCENTAGE FOR MEETING/ EXCEEDING THE AQL (Incentives/Disincentives) 1. Quality of Deliverables: Produce Deliverables that conform to Statement of Work requirements. All (100 percent) of the Deliverables must conform to the requirements set forth in the contract Statement of Work. The Government assumes that all (100 percent) of the Deliverables will meet contract requirements. Deliverables will be reviewed for quality; i.e., the Government will use 100 percent inspection. No rework will result in full payment of contract price Deduct of 50 percent will be made for any deliverable that requires rework. 2. Timeliness: Complete Deliverables by the schedule date. Deliverables must be completed on time. No Deliverables can fail to meet the schedule date for completion. Deliverables will be reviewed for timeliness; i.e., the Government will use 100 percent inspection. Producing Deliverables by the required schedule dates will result in full payment of contract price. Deduct of 50 percent will be made for any deliverable that fails to meet schedule dates. 14. PERFORMANCE ASSESSMENT PLAN 14.1. Performance Assessment. The Government will evaluate the quality of the MRO?s performance under this contract using quality assurance procedures to insure that service levels are met and to provide a proactive way for the COTR to avoid unacceptable or deficient performance. This assessment also provides verifiable input for the required annual past performance evaluations. 14.2 Performance Review Meetings. a. The MRO shall attend performance review meetings in order to discuss and document MRO performance. These meetings will take place weekly for the first two months of contract performance, after which they will occur monthly. The COTR and the contract specialist shall represent the Government. The MRO any other MRO employee, as directed by the COTR, shall represent the MRO. Technical requirements of the contract shall be coordinated with the COTR and normal day-to-day operations shall be coordinated with the COTR. b. The purpose of the performance review meetings will be to document acceptable/unacceptable MRO performance during the month being measured. c. The conduct of the meeting will focus on instances during the month where MRO performance did not meet the levels specified in the contract, or where further quality improvements can be made. During the performance review meetings, both parties will make a good-faith effort to resolve any differences. Failing to resolve their differences, the report will be remanded to the Administrative Contracting Officer for final determination. 14.3 Performance Evaluation. a. Performance Standards. The MRO shall be responsible for meeting all performance standards stated in the Statement of Work, and will be held accountable for consistently providing services of the quality, timeliness and accuracy specified. In order to effectively monitor MRO performance, key requirements necessary to acceptable contract performance have been identified by the BEP for continuing evaluation by the COTR. See Performance Requirements Summary Chart. 1). Timeliness/Responsiveness-The COTR will determine whether the MRO has been timely and responsive to contract requirements. 2). Quality-The COTR will determine whether the MRO has met all requirements with regard to providing a trained, professional staff with credentials and experience who provide quality work in accordance with the Statement of Work. The COTR will determine whether parameters stated in SOW have been met and BEP and Government Directives, regulations, policies and procedures, adhered to. The COTR will determine whether the MRO has provided the services outlined in the contract accurately. The COTR will determine whether the objective was accomplished and the requirements met. b. Incentives/Disincentives and Acceptable Quality Level (AQL). In all cases, the MRO will be required to take corrective action when the performance standards specified in the contract are not met. c. Payment Reduction. The Contracting Officer shall inform the MRO in writing of the type and percentage of proposed deduction in accordance with the Performance Requirements Summary, within five (5) business days succeeding the end of the month for which the deduction(s) are to be made. The MRO, may, within five (5) business days of the written notification from the Contracting Officer of the proposed deductions, present to the Contracting Officer in writing specific reasons why any or all of the proposed deductions are not warranted. Any reasons stated should provide specific facts, which justify reconsideration and adjustment of the proposed amount to be deducted. Failure to respond within the 5 business day period shall be deemed acceptance of the Government?s proposed deductions. After consideration of the MRO?s reply, if any, the Contracting Officer shall submit to the MRO, in writing, the Contracting Officer?s determination on the amount of deductions to be subtracted from the MRO?s monthly invoice. The Contracting Officer will consider any pertinent information submitted by the MRO. However, the final decision on the amount to be deducted in accordance with the Performance Evaluation and the Performance Requirements Summary is a unilateral Contracting Officer?s decision that is not subject to the Disputes Clause. Continued failure to meet the requirements may result in contract termination.
