- Attachment 1 Part 1-STATEMENT OF WORK - MEDICAL REVIEW OFFICER SERVICES C.1. Introduction The Department of the Treasury?s Bureau of Engraving and Printing (BEP) is the nation?s primary producer of currency. We operate in two locations: Washington, DC, and Fort Worth, TX. BEP employs approximately 2,340 employees (1,650 in Washington and 690 in Fort Worth). The BEP is dedicated to ensuring the eradication and deterrence of drug abuse among its employees at both facilities. The major objective of this statement of work (SOW) is to obtain Medical Review Officer (MRO) services. These services are required to expedite the administration of the BEP Drug-Free Federal Workplace Program in an effective and efficient manner. In accordance with Executive Order 12564, BEP established the Drug-Free Federal Workplace Program (DFFWP) in 1989. The DFFWP implemented by BEP is based on the scientific and technical guidelines issued by the Secretary, Department of Health and Human Services and the Office of Personnel Management. The BEP?s random testing pool includes approximately 1,800 employees. Background The BEP DFFWP is effective for all employment applicants, and for positions designated as a Testing Designated Position (TDP). TDPs are designated for random drug testing because they required the highest degree of trust and confidence. Employees in TDPs subject to random drug testing include: * Employees granted access to classified national security information (Top Secret, Secret and Confidential clearance holders); * Employees in the Senior Executive Service; * Employees authorized to carry or have access to firearms; * Employees who operated fork lifts and other materials handling machinery; and * Other identified positions requiring the protection of life and property, public health or safety, and other positions requiring a high degree of trust and confidence. The BEP Drug Testing Program includes the following types of drug testing: * Applicant Testing (Pre-Employment); * Random Testing of employees occupying TDPs; * Reasonable Suspicion Testing; * Voluntary Testing; * Unsafe Practices/Post-Accident Testing; and * Follow-Up (including Return to Duty) testing. C.2 Definitions For the purposes of this SOW, the following will apply: Contractor (Third Party Administrator) ? The individual or company that serves as the primary point of contact and focal point for passage of records and materials and who is responsible for the implementation of drug testing collection. Collector ? An individual who performs the function of collecting urine specimens for drug analysis. The collector may be an employee of the contractor, or may be an individual designated by the contractor to perform the collection function. Collection Site ? The collection site is the location for specified applicants/employees to present themselves for the purpose of providing their urine specimens under controlled conditions. Drug Program Representative ? A BEP employee who assists the collector during random specimen collections and who is available to answer any questions regarding the collection that may arise from the applicant/employee. The Drug Program Representatives interface with the laboratory and the MRO to obtain drug testing results and information relevant to the results. Contracting Officer?s Technical Representative (COTR) ? The BEP Drug Program Representative specifically designated to interface with the Contractor, Laboratory or Medical Review Officer, regarding contract performance and/or any issues that arise. Applicant ? An individual not generally employed by the BEP who has applied for a position covered by this SOW. Employee ? An individual employed by the BEP. Pre-employment ? A phase within the employment process in which a candidate is tentatively selected for a specific position covered by this SOW. Laboratory ? A laboratory certified by the Department of Health and Human Services (DHHS) to provide full service drug collection specimen analysis in accordance with scientific and technical guidelines established by the DHHS. Medical Review Officer ? A licensed physician responsible for receiving laboratory results generated by the BEP?s drug testing program. The MRO has knowledge of substance abuse disorders; and has appropriate medical training and accreditation to interpret and evaluate an individual?s positive test result, together with medical history and any other relevant bio-medical information. C.3. REQUIREMENTS C.3.A. Scope of Work The DFFWP implements Executive Order 12564. The services detailed shall be performed in accordance with this SOW, as well as the ?Medical Review Officer Manual for Federal Workplace Drug Testing Program? developed by the DHHS. This manual applies to Federal Agency Workplace Drug Testing Programs that come under the Executive Order and the Department of Health and Human Services (DHHS) Mandatory Guidelines. Implementation of the ?Mandatory Guidelines for Federal Workplace Drug Testing Programs? (Attachment #1) is mandatory. The guidelines provide comprehensive standards, which include the use of the best available technology to ensure full reliability, accuracy of drug tests, and strict procedures to govern the chain of custody of the specimens. BEP conducts approximately 2,050 drug tests annually; approximately 1,800 random drug tests, approximately 250 applicant drug tests, and any required drug tests included in other categories of testing. BEP is a three-shift manufacturing facility operating 24 hours daily, five to six days per week. C.3.B. Testing Urine testing is conducted to detect and deter illegal drug use by civilian employees. Six types of testing are planned as follows: 1. Pre-Employment Testing ? These services support pre-employment screening and must be scheduled within 24 hours after the contractor notification date. 2. Random Testing ? Unannounced testing of employees are based on the current random selection. Random testing of the first shift will occur during generally standard business hours, i.e. 9:00 a.m. to 2:00 p.m. local time. Random testing of the second and third shifts will occur during generally non-standard business hours, i.e. 7:00 p.m. to 3:00 a.m. The contractor may be required to schedule the four following types of drug testing at any time during the day, including weekends and holidays: 3. Reasonable Suspicion Testing 4. Post-Accident of Unsafe Practice Testing 5. Follow Up (including Return to Duty) Testing 6. Voluntary Testing Only proper federally approved Custody and Control Forms (currently OMB Number 0930-0158, Exp Date: June 30, 2003, Federal Drug Testing and Control Form) shall be utilized for the purpose of maintaining control and accountability from initial collection to final disposition of all specimens. The forms will identify the specimens through the use of information which matches label items, and a sequential number assigned to each urine specimen obtained. With each transfer of possession, the Custody and Control Form must be signed and dated (including the time) by the individual releasing the specimen. The contractor/collector will be subject to collection control inspections by the BEP. The MRO may be contacted, by the COTR or any other Drug Program Representative, telephonically to resolve problems concerning applicants of employees who are unable to provide a specimen while at the collection facility. The MRO may be contacted during non-standard hours. C.3.C Quality Control/Quality Assurance: Medical Review Officer The MRO shall be responsible for the quality and timeliness of all services and products obtained under this SOW. This includes professionalism, courtesy of customer service, and integrity of sub-contractors. Emergency requests (e.g., reasonable suspicion or post-accident) may occur at any time of the day or week, at any location. The MRO may be contacted at any time and, immediately upon award of the contract, shall provide the BEP with an after-hours telephone number for MRO consultation. The MRO shall establish a drug-free workplace program to ensure that all employees involved in the processing of drug test results, and in any phase of the chain of custody procedures, are drug-free. The MRO shall provide proper training to all individuals performing service under the contract specifications. Prior to any specimen result adjudication the MRO shall provide proper training on the DHHS guidelines. The MRO shall provide the BEP a specimen adjudication statistical summary report no later than the fifth of each month. The report shall contain specific details on the number of adjudications (positive, negative, canceled, insufficient specimen quantity, adulterations, dilutions, substitutions) and the costs incurred. Within 48 hours of notification of a problem or issues between the BEP and the MRO, the MRO shall be responsible for researching and reporting, in writing, the corrective actions/resolutions. As stated in the MRO Manual, the DHHS recommends that MRO?s develop and maintain a written Standard Operating Procedure (SOP) manual. The MRO shall make their written SOP available for review by the COTR/Drug Program Representatives. If the MRO does not maintain a written SOP, the MRO shall describe their procedures to the BEP representatives. The COTR or Drug Program Representative may contact the MRO telephonically to resolve problems concerning applicants or employees who are unable to provide a specimen while at the collection facility. C.3.D Specific Requirements (1). Hours of Operation The MRO will routinely be available to the BEP on a Monday through Friday basis during the hours of 8:30 a.m. to 5:00 p.m. Eastern Time. As needed the MRO shall be available to respond to issues or questions during all other times. (2). Security Procedures The Government reserves the right to require a full-field background investigation of any contractor employee assigned to perform services if deemed appropriate by the BEP. The BEP will assume the cost of the background investigation. The MRO is responsible for ensuring that all information and medical records obtained are maintained in a strictly confidential manner. The records shall be stored either in locked, fireproof metal filing cabinets or in a secured room that is not accessible to the general public or visitors. (3). Release of Information All records are subject to the Privacy Act, 5 U.S.C., 552A. The information and records shall be maintained and used with the highest regard for applicant/employee privacy. Applicants/employees may review the information obtained from their drug test. However, they shall not be allowed unsupervised access to their medical records. Applicants/employees may obtain a copy of their drug test results by sending a notarized letter authorizing release of the information, to who the information is to be released, along with the address where the information is to be mailed. Washington, DC 20028-0001 (4). Release of Drug Test Results The MRO shall release verified BEP drug test results only to the designated Drug Program Representatives. The BEP will provide the MRO with a list of personnel authorized to receive drug test results and supporting information such as the MRO Checklist. (5). Professional/Technical Requirements The MRO shall maintain, update and provide to the BEP, upon request, the current professional credentials of all individuals providing services under this SOW. The information shall be available to the BEP at all times. At a minimum, the following requirements will be met: MRO Professional Credentials Include: a. Complete name, office address and telephone number b. Copy of current professional licensure c. Proof of current malpractice insurance d. Completion of courses for licensed physicians in the MRO specialty, particularly courses from the professional organizations specified by the DHHS e. Curriculum Vitae (6). Toll Free Telephone Number The MRO shall provide the BEP with a toll free telephone number. The MRO shall also provide this number to any applicant or employee who the MRO needs to contact regarding their drug test, and who is unavailable at the time the MRO calls. (7). MRO Non-Availability The MRO shall provide the BEP with an alternate MRO, including 24-hour contact information, in the event of MRO non-availability. The alternate MRO shall possess the professional credentials and accreditation required by this SOW. The alternate MRO professional credentials shall be available to the BEP. C.4. Quality and Timeliness of Service (1). Documentation The MRO shall review the information on the specimen Custody and Control Form and determine that the information is forensically and scientifically supportable. The MRO shall review the laboratory test results and determine that the information is forensically and scientifically supportable. (2). Donor Interview The MRO shall interview the donor as required to verify the test result. (3). Negative Laboratory Tests, Including Insufficient Quantity to Test The BEP shall receive verified, negative laboratory results within 1 working day of receipt by the MRO, except in such cases as the MRO may not receive the MRO copy of the federal Custody and Control Form from the collector with timeliness. (4). Positive Laboratory Tests/Refusals The BEP shall receive verified, positive laboratory results and refusals within 5 working days of receipt by the MRO, except in situations such as the inability to complete donor contact or an unusually complicated verification due to donor response. Upon verification the MRO will immediately provide the BEP with an electronically transmitted copy of the MRO Checklist. (5). Canceled Test In circumstances whereby the MRO is required to make a determination regarding a donor?s inability to provide a specimen, the MRO shall inform the BEP of the test status within 5 days of notification by the BEP or the collectors. The MRO shall keep the BEP informed of progress in obtaining relevant medical information from the donor, and shall report results immediately upon verification. (6). Donor Representation If the donor requests representation before or during the MRO interview this shall be permitted even if it delays completion of the verification process. The MRO shall immediately notify the BEP of the reason(s) for the delay. (7). Electronic Transmission of Results The MRO must have the capability to electronically receive laboratory test results transmitted by the contract laboratory. The MRO must also have the capability to electronically transmit verified test results to the BEP. (8). Laboratory Affiliation As required by the federal Mandatory Guidelines, the MRO shall not be an employee or agent, or have any financial interest in the laboratory for which the MRO is receiving drug testing results. The MRO shall not derive any financial benefit by having the BEP use a specific drug testing laboratory, nor have any agreement with the laboratory that may be construed as a potential conflict of interest. (9). Testimony The MRO shall provide support in litigation in the form of documentation or testimony. The MRO shall provide the BEP with the MRO?s hourly rate for providing testimony during litigation. If required to travel to support litigation the BEP shall provide payment of travel expenses according to the federal schedule. C.5. SUPPORTING INFORMATION. 5.1 SECURITY. 5.1.1 CLASSIFIED MATERIALS. No access to national security information is required for the performance of this contract. 5.1.2. SENSITIVE INFORMATION. Much of the information that will be accessed and processed as part of this contract may be considered sensitive due to the Privacy Act or due to its relationship and import to BEP functions and procedures. All sensitive information shall be divulged only to authorized persons and not outside of BEP. 5.1.3. INFORMATION SECURITY. All information that may be provided to facilitate performance of the work, or which is generated as a result of performance of the services required by the contract is sensitive and shall not be released to third parties without the express, written consent of the Contracting Officer. This information requires strict control procedures to preclude its unauthorized disclosure or dissemination. As determined by the BEP, failure to protect identified information may result in the denial of access to the BEP premises and subsequent removal from this contract of the individual responsible. The MRO is responsible for protecting authorized release. 5.1.4. NON-DISCLOSURE REQUIREMENTS. The MRO shall sign, and require all employees to sign, a non-disclosure statement. Information pertaining to the subject matter and content of work under this contract is sensitive and shall not be discussed with personnel outside of those assigned to work directly on this contract, except as required by the Government on a strict need-to-know basis. Release of information pertaining to the existence of or content of this contract for marketing purposes is expressly prohibited. The requirement for non-disclosure of the BEP sensitive information found in this contract is a material requirement of the contract. This provision shall be included in any purchase orders or subcontracts issued by the MRO pursuant to this contract and such purchase orders or subcontracts shall include the attached non-disclosure statement.
