Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Written quotations are being requested. Quotes may be submitted on the Standard Form 18 (Request for Quotation). Small Business Standard size: NAICS 325120, Standard Size: 1,000 employees Statement of Work For Compressed Gas Cylinders General The contractor shall furnish compressed gases and select liquid chemical cylinders to the U. S. Environmental Protection Agency, Gulf Ecology Division, at 1 Sabine Island Drive, Gulf Breeze, FL during normal business hours and shall maintain the compressed gas cylinders in accordance with required regulations and specifications. It is the intent of the Government to establish a Blanket Purchase Agreement (BPA). The period of performance shall not exceed 5 years or the total amount of calls placed against the BPA shall not exceed $100,000. The Government reserves the right to terminate the agreement at any time after giving the contractor a 30 days written notice. Compressed gas cylinders will be located in the storage building or designated location as directed by the contracting officer or authorized representative. It is estimated that 125 cylinders will be required at the start of the contract and additional cylinders will be required throughout the period of performance. Replacement of defective gas cylinders will be performed by the contractor when required to meet safety, operational and regulatory requirements. Contractor must provide pricing per cubic foot. Contractor shall provide pricing on a list of gases in with designated purity rates. This list will be provided upon request by the contractor. A site visit is scheduled for Thursday, April 27, 2006 starting at 9:00 a.m. central standard time. Contractors shall provide all names of individuals attending to the point of contact prior to April 27, 2006. Definitions Regular delivery ? weekly delivery on one designated day. Emergency delivery ? within 24 hours after receipt of telephone or written notice from contracting officer or designated representative. Normal business hours ? Monday through Friday, 7:30 am ? 4:00 p.m. Contractor Furnished Items and Service The contractor shall furnish all equipment needed to perform this contract according to all the terms. Specific tasks The contractor shall provide their Tax identification and Dunn and Bradstreet number with their initial quote. The contractor shall provide written certification, if they are exempt from the service contract act. If the contractor is subject to the service contract act, they shall provide the occupational title of all employees that would be performing under this agreement. A copy of the act will be provided upon request by the contractor. The contractor shall provide a copy of their Quality Control Plan to the government with their quote. The contractor?s quality control plan shall list steps taken to prevent delivery of contaminated gases. Contractor shall test each cylinder to ensure that the cylinder is in accordance with all OSHA, Federal and safety regulations. Each tank shall be labeled and marked to meet all safety and regulatory requirements of the type of gas contained. Each cylinder shall be marked with the date of delivery made to the government. Upon request by the contracting officer or authorized representative, the contractor shall provide the government with a certificate of conformance analysis or batch analysis. The contractor shall provide the attached list of compressed gas cylinders upon award of the contract and shall provide additional cylinders as required throughout the period of the contract. Contractor shall provide certificates for all cylinders that are listed for initial start up. The contractor shall deliver cylinders to designated locations; off load cylinders at proper designated storage location and load empty cylinders. Contractor shall deliver cylinders weekly on one agreed upon designated day. The contractor shall provide cylinders on an emergency basis as required by the contracting officer or designated representative. Contractor shall provide the government with a list of cylinders by serial number remaining on the island for over 30 days. The government shall not incur rental charges on cylinders that are routinely delivered and remain on the island for less than 30 days. The government is not obligated to order any supplies under this agreement. The government is obligated only to the extent of authorized calls placed against the Blanket Purchase Agreement. Contractor?s performance will be monitored during this contract. Performance of this service will be evaluated to determine whether the contractor meets the performance requirements. When unacceptable performance or contaminated gases are delivered the contracting officer will notify the contractor in writing. The contractor shall respond to the contracting officer within 7 calendar days of receipt as to the corrective or compensation that will be taken by the contractor. The method we will use to determine quality assurance will be random sampling of the gases and liquids. The total amount of all calls placed shall not exceed $100,000. The vendor shall notify the Contracting Officer in writing whenever they have reason to believe that the next call order placed against the Blanket Purchase Agreement exceed $100,000. The government is not obligated to pay the vendor for any costs that exceed $100,000. The vendor is not obligated to accept calls placed against this BPA in excess of $100,000. The vendor warrants by performance that any call placed under this agreement for cylinders that are not listed shall be accomplished with a price list and the Government shall receive prices as low as or lower than those charged the contractor?s most favorite customer for same or comparable service under similar terms and conditions, including discounts for prompt payments. The issuance of individual calls on the open market under this agreement will be made in accordance with the Federal Acquisition Regulations. Calls placed under this Agreement will made by oral solicitation without a written confirmation by the ordering officer. Each call will be assigned an identification number. The number will identify the fiscal year the call is placed and the consecutive call number of the action (call) within the fiscal year. Example: The first call place in fiscal year 2006 shall be designated 06-01. The first two digits (06) designate the year. Should 34 calls be placed between October 1 and September 30, the final call shall be 06-34. On October 1, 2006 (the initial day of fiscal year 2007) the numbering system shall begin with 07-01. All calls place with the vendor under this agreement must be accompanied by a BPA ?Call Number? authorized by the Contracting Officer. Upon award, a list of individuals will be provided to the contractor with the names of all authorized individuals, which can place calls. The contractor shall only accept calls from the individuals provide on the list. Any calls placed by individuals other than those authorized callers listed above will be considered as unauthorized procurements and the individuals unauthorized caller may be liable for the cost of the services or supplies provided. Performance and Delivery. a. All commodies or services requested under this agreement shall be delivered to the address as specified on each individual call. b. All call placed under this Agreement shall be shipped complete. No partial shipment will be accepted. c. All deliveries shall be made within the time agreed upon by the vendor and the BPA caller when the call is placed. d. Delivery of all items under this Agreement shall be f.o.b. destination. e. A material safety data sheet (MSDS) for the list of gases request shall be submitted to the contracting officer prior to award. A material safety data sheet must be submitted to the contracting officer for all gases that are not provided for the initial start up. The list and purity rates will be provided upon request. Delivery tickets A requirement that all shipments, except those for newspapers, magazines, or other periodicals, shall be accompanied by delivery tickets or sales slips that shall contain the following minimum information: (i) Name of supplier. (ii) BPA number. (iii) Date of purchase. (iv) Itemized list of supplies or services furnished. (v) Quantity, unit price, and extension of each item, less applicable discounts (unit prices and extensions need not be shown when incompatible with the use of automated systems, provided that the invoice is itemized to show this information). (vi) Date of delivery or shipment. (vii) Blanket purchase agreement call number (viii) Name of EPA individual placing the order The vendor shall submit a summary invoice for the period ending the 24th of each month. Any transaction after the 24th of each month shall be submitted on the next month summary invoice. A summary invoice shall be submitted at least monthly or upon expiration of this BPA, whichever occurs first, for all deliveries made during a billing period, identifying the delivery tickets covered therein, stating their total dollar value, and supported by receipt copies of the delivery tickets. ONLY A SUMMARY INVOICE WILL BE ACCEPTED FOR EACH MONTH UNDER THE TERMS OF THIS AGREEMENT. ALL INVOICES RECEIVED OTHER THAN SUMMARY INVOICES WILL BE RETURNED TO THE VENDOR. A summary invoice shall be submitted to the address listed below: U. S.
