Sources Sought Notice to Exchange Commodity Credit Corporation (CCC) Donated Nonfat Dry Milk (NDM) for Ultra High Temperature Milk (UHT) Description: The Kansas City Commodity Office (KCCO), Dairy & Domestic Operations Division (DDOD), is seeking qualified companies to supply Ultra High Temperature Milk (UHT) 12/32 fluid ounce aseptically processed and packaged (Commodity Code B413); (hereinafter referred to as finished product) for Food and Nutrition Service (FNS) distributing agencies, in exchange for approximately 14 million pounds of CCC donated NDM. The projected timeline for delivery of finished product is August through December 2006. This notice will serve as market research to obtain information for the commercial finished product sought. Information gathered from qualified supplier(s) in response to this Sources Sought Notice will be catalogued and distributed to FNS and the Pennsylvania State Distributing Agency; (hereinafter referred to as SDA) and used solely for planning and ordering finished product. This notice is not a formal solicitation but a request for interested parties to provide finished product information. The SDA will contact and contract with the participating supplier(s) of their choice. The SDA will have 10 business days from the receipt of the catalogue to contact and contract with supplier(s) to furnish the finished product. After the SDA selects a supplier(s), the supplier(s) will have 10 business days from the SDA contact date to furnish a performance bond to the SDA. The SDA is responsible to notify and provide CCC a copy of the performance bond of the supplier(s). The bond shall be for an amount equal to or greater than the value of the NDM to be received. Issuance of the Notice to Deliver (N/D) and transfer of title of NDM will be authorized as soon as possible after CCC?s receipt of the performance bond furnished by the SDA. This will allow exchange of NDM prior to delivery of finished product. A. NDM will be exchanged in store (pallet exchange basis) at the point(s) of CCC storage to the designated supplier(s) in care of the SDA. CCC will issue to the warehouseman an N/D to transfer the NDM to the supplier(s). The original N/D will be mailed to the warehouseman and a copy will be mailed to the supplier(s). The date of mailing the N/D shall be the next day following date of issuance. B. CCC shall be responsible for any storage charges accruing up to and including the tenth business day following the date of issuance of the N/D or until the NDM is loaded out, which ever is earlier. Any storage, handling, or other warehouse charges accruing thereafter shall be for the account of the supplier(s). Notwithstanding the foregoing, any prepaid warehouse charges, including loading-out charges, on any lot of the NDM delivered to the supplier(s) shall accrue to the benefit of the supplier(s). C. Title and risk of loss shall pass to the supplier(s) when the NDM is delivered to the supplier(s). All NDM that SDA awarded to the supplier(s) shall be transferred to the supplier(s) by June 30, 2006. The NDM donated to the SDA by CCC and released in store is projected to have a manufacture date during calendar year 2000 for approximately 700,000 pounds and the remaining NDM will have a manufacture date during calendar year 2001 or newer. All NDM will be standard grade or higher as evidenced by the most current grade certificate issued by USDA/Agricultural Marketing Service (AMS), Dairy Programs. Finished product delivered to the SDA must be manufactured in plants that are inspected and approved by the Dairy Grading Branch, Dairy Division, Agricultural Marketing Service (AMS). Finished product shall meet the specifications of the Commercial Item Description (CID) A-A-200338 which is available at http:/www.ams.usda.gov/fqa/ciddair.htm. All quantities of finished product requested by the SDA are subject to the availability of NDM for exchange. Interested supplier(s) should submit the following information: Name, address, contact person, title, telephone and fax numbers, email address, and available website. Each supplier(s) must provide the following information for UHT 2% Milkfat 12/32 fluid ounce cartons: finished product price per net pound, NDM price per net pound, a single firm-fixed exchange rate for contiguous U.S. in pounds of NDM per net pound of finished product; quantity per case; and pallets per truckload based on FOB destination to the states listed below. Each supplier(s) must provide finished product brand name, ingredients composition, nutrition facts, servings per container, shelf life, and proof of AMS approval for finished product manufacturing plant, and any other information needed or requested by the SDA to place finished product orders. All finished product supplier(s) shall comply with all applicable Federal and State mandatory requirements and regulations relating to the preparation, packaging, labeling, storage, distribution of the finished product within the commercial marketplace. The delivered finished product shall comply with all applicable provisions of the Federal Food, Drug, and Cosmetic Act, the Fair Packaging and Labeling Act, and regulations promulgated there under. The single firm-fixed exchange rate in pounds of NDM per net pound of finished product shall apply to the contiguous U.S. The approximate percentage of truckloads ordered and possible destinations are listed below for information only: Northeast Region : (CT,ME,MA,NH,NY,VT) 10 % Mid Atlantic Region: (DE, DC,MD, NJ, PA, VA, WV) 11% Southeast Region: (AL,FL,GA,KY,MS,NC,SC,TN) 20% Midwest Region: (IL,IN,MI,MN,OH,WI,) 16% Southwest Region: (AR,LA,NM,OK,TX) 14% Mountain Plains Region: (CO,IA,KS,MO,MT,NE,ND,SD,UT,WY) 7% Western Region: (AZ,CA,ID,NV,OR,WA) 19% NOTE: Truckload shipments will be limited to one stop and a final. In addition, interested suppliers shall submit separately, for each of the following offshore destinations, a single firm-fixed exchange rate in pounds of NDM per net pound of finished product delivered f.o.b. destination via marine containers. The approximate number of marine containers by destination are listed below: Puerto Rico 27 containers Virgin Islands 1 container N.
