AMENDMENT NOTICE: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, in conjunction with FAR 13.5, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number is 1069-6G7020 and is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 05-08. The associated North American Industrial Classification System (NAICS) code for this procurement is 421610 with a small business size standard of 500 employees. This requirement is a [ Small Business ] set-aside and only qualified offerors may submit a quote. The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on Tuesday, April 25, 2006 at 14:00:00 Eastern Time or as otherwise displayed at www.FedBid.com. FOB Destination shall be Springfield, VA 22153 The Department of State requires the following items, EXACT MATCH ONLY, to the following: LI 001, Sig P229 Compact Semi-Auto Handgun w/integral Picatinny-Style Accessory rail w/13 rd L.E. Magazines. 9X19mm (9mm NATO) Nitron Black Matte Finish, Trijicon Night Sights, Lockable case, gun lock, manual PART: E29R-9-BSS-G, 300, EA; LI 002, P228/P229 13 RD MAGAZINES, LAW ENFORECEMENT FINISH #34280222, 600, EA; LI 003, SHIPPING, 1, LOT; For this solicitation, Department of State intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing quotes, which descend in price during the specified period of time for the aforementioned reverse auction. Department of State is taking this action in a an effort to improve vendor access and awareness of requests while expediting its ability to gather multiple, completed, real-time offers. All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their offer using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make an offer on www.FedBid.com. Offerors that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. Offerors may not artificially manipulate the price of a transaction on www.FedBid.com by any means. CCR Requirement - Company must be registered on Central Contractor Registration (CCR) before an award could be made to them. The following FAR clauses in paragraph (b) of FAR clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, will apply: 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. FAR 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition. The selected Offeror must submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items. FAR 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. In addition to providing pricing at www.FedBid.com for this solicitation, each Offeror must provide any required, NON-PRICING responses so that they are received at that email address no later than the closing date and time for this solicitation. Delivery shall be made within 30 days or less after receipt of order (ARO). Offerors are cautioned to address each specification completely when submitting their bid. Offerors that do not address each specification fully may be rejected without further consideration. NOTE: Offerors quoting the brand name product that are not the manufacturer or an authorized distributor of the brand name product MUST submit a signed letter from the manufacturer of the brand name product stating the following: Manufacturer, has agreed to supply brand name product to Your company for the purpose of providing the supplies to the DoS. Letter MUST be on the manufacturers company letterhead and submitted by the closing date of the auction. This MUST be provided in order to be considered for award. NO EXCEPTIONS Sig Sauer P229 9mm pistol is the issued pistol that all agents are trained on. Overall length: 7.1 inches, Overall height: 5.4 inches, Overall width: 1.5 inches, Barrel length: 3.9 inches, Weight w/o mag: 28.1 oz, Mag weight: 3.0 oz, Sight radius: 5.7 inches. State Department requires the Law Enforcement magazine which holds 13 rounds and DS also requires the Trijicon night sights as authorized by the DS Firearms Policy Review Board. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304-(2) or 41 U.S.C. 253-(2) . The regulatory authority is FAR 6.302-1, Only one responsible source and no other supplies or services will meet the agency?s need. Description of efforts made to ensure that offers were solicited from as many sources as practicable: The weapons requested are what the agents were trained to use during their initial training as Diplomatic security Service Special Agent Training. The economic impact to the U.S. Government for using other items than what is requested, would be great and would involve the retraining of all agents in the field including purchasing all new weapons systems to issue to the various mission locations be it overseas or abroad. Sig Sauer is the manufacturer of the P229 Pistol. A description of the market research conducted and the results or statement of reasons a market research was not conducted: The DS Firearms Policy and Review Board (FPRB) has approved the use of the Sig Sauer as the ONLY pistol authorized for use by DS Agents. Therefore, no market research was done. Any other facts supporting the use of other than full and open competition: The weapons system described above are to be utilized by the agents assigned to Domestic and overseas posts. The vendor states that the lead time on these items is 45-60 days from the date of order and no other source could provide them in such a timely manner, these items are needed as soon as possible, so it is imperative that this be treated as circumstances permitting other than full and open competition. DS has verified that the request as described represents the government?s minimum requirements.
