Description
This is a combined synopsis/solicitation for commercial item(s) prepared in accordance with FAR 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Proposals are requested and a written solicitation will not be issued. W81XWH-06-T-0225 is issued as the Governments Request for Quote (RFQ). The solicitation document and incorporated Provisions and Clauses are those in effect through Federal Acquisition Circular (FAC) 2005-0 3. This procurement is set side for small businesses. The SIC Code is 2835; the North American Industry Classification System (NAICS) code is 325413, small business size standard is 500 employees. The U.S. Army Medical Research Acquisition Activity inte nds to procure NSN 6550014465765 Test Kit CK- MB Myoglobin 20 P (Quantity 60) Each and NSN 6550014555546 Test Kit CK- MB (Quantity 10) Each. All items are to be delivered FOB Destination to Savage, MD. The U.S. Army Medical Research Acquisition Activity Contracting Office intends to award on a brand name (Nanogen) or equal basis. (PLEASE SEE FAR 52.211-6 Clause incorporated in full text below). The U.S. Army Medical Research Acquisition Activity Contracting Office intends to issue a firm fixed price cont ract. The following Provisions and Clauses are incorporated and shall remain in full force in any resulting purchase order: FAR 52.212-1 Instructions to Offerors- Commercial Items; FAR 52.212-2 Evaluation of Commercial Items apply to this acquisition. Co ntract will be awarded on low price, technically acceptable basis. FAR 52.212-3 Offeror Representations and certifications; FAR 52.212-4 Contract Terms and Conditions-Commercial Items; FAR 52.212-5 Contract Terms and Conditions Required to Implement Stat utes or Executive Orders; FAR 52.222-3 Convict Labor; FAR 52.222-19 Child Labor; FAR 52.222-21 Prohibition of Segregated Facilities; FAR 52.222-26 Equal Opportunity; FAR 52.222-36 Affirmative Action for Workers with Disabilities; FAR 52.232-26 Payment By Third Party; FAR 52.247-34 FOB Destination; FAR 52.252-1 Solicitation Provisions Incorporated By Reference; FAR 52.252-2 Clauses Incorporated by Reference; DFARS 252.204-7004 Required Central Contractor Registration, and DFARS 252.212-7001 Contract Terms a nd Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items. 52.211-6 BRAND NAME OR EQUAL (AUG 1999) (a) If an item in this solicitation is identified as brand name or equal, the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristic s that equal products must meet are specified in the solicitation. (b) To be considered for award, offers of equal products, including equal products of the brand name manufacturer, must-- (1) Meet the salient physical, functional, or performance characteristic specified in this solicitation; (2) Clearly identify the item by-- (i) Brand name, if any; and (ii) Make or model number; (3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and (4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications. (c) The Contracting Officer will evaluate equal products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtai ning any information not identified in the offer. (d) Unless the offeror clearly indicates in its offer that the product being offered is an equal product, the offeror shall provide the brand name product referenced in the solicit ation. The Government reserves the right to make award on the initial proposals received without discussions. The Government will only consider quotes received by 1200 PM EST on 25 May 2006. Vendors must be FDA approved for the manufacture, sale, and distribution of these products. Interested parties shall provide detailed information o n proposed products, which clearly meet the requirements stated above.
