- 13. "The CCS shall be capable of being shipped via common carrier without special handling or packaging. The system, including the batteries, shall not need to be classified as hazardous material per 49 CFR Part 173." This requirement, if strictly interpreted, will effectively preclude the use of Lithium ion batteries in the portable units, thereby increasing their weight and substantially reducing the available battery run time. It is also likely to increase the cost of the system significantly. To meet the above solicitation requirement, is it acceptable to ship the portable units individually, and to impose the requirement that the boxes be labeled in accordance with existing regulations? Further, can the definition of "shipping" be limited to common carriers within the US and its possessions, since international requirements for Lithium ion batteries are much more strict than US requirements? Answer: Our interpretation of 49 CFR Part 173 is that rechargeable lithium ion batteries are not hazardous material and do not warrant special handling or packaging. Shipping is defined at the continental United States and it's territories.
