- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Provide ONE armed guard on a 24 hours per day,7 days per week basis for Force Protection duties and armed with the following weapons: The Guard will carry one 9mm or 45 cal pistol AND one 12 gauge shotgun. Guard will also have "at the ready" a .308 cal rifle. Provide ONE Unarmed guard on 24 hours per day, 7 days per week basis for Force Protection duties. NO GUARDS WILL BE REQUIRED WHILE THE VESSEL IS IN DRYDOCK. NO small boats are currently required. However, the Commercial Company should have the capability to provide one small boat with one operator and one guard armed with a 9mm pistol and .308 cal rifle. This requirement should be "scalable" meaning that if, at some point, it is no longer necessary or more requirements need to be met, there will be a proportional change in cost. Contractor must be certified and approved by C3F via COMSCPAC FPO) to submit a proposals. ONCE A COMPANY IS AWARDED THE CONTRACT, THE COMPANY SHOULD IMMEDIATELY NOTIFY THE FOLLOWING INDIVIDUALS AS SOON AS POSSIBLE: A. MSCPAC N34 Phil Patton 619-524-9736 Philip.Patton@navy.mil, B. The Commercial Security Company should provide the following equipment for each guard as part of their services: 1. Guards, Firearms, and Ammunition (at least 50 rounds per weapon), 2. Three Warning Flares (Captain and Security Company will discuss safe use of Flares prior to their use with due consideration for the specific characteristics of the ship), 3. One Night Vision device (devices that will not be washed out by pier/harbor lights), 4. One operable Bull Horn (megaphone) with batteries, 5. Two Walkie Talkies, 6. One Cell Phone, 7. Personal protective equipment (such as helmet/flak jackets) as company deems suitable, 8. One pair of Binoculars. All guards must meet all state and federal regulations pertaining to security duties including guard cards, firearms cards, and Dept of Justice Background checks. The guards must be United States Citizens. No guard must have been convicted by a court of any felony, any class A or class B misdemeanor, or any act which would constitute perjury or false statement. No guard must have tested positive on any controlled drug screen. In a case where firearm cards do not exist for certain types of weapons, guards will have a minimum of 8 hours training from a qualified instructor on the storage, care, and use of the firearm to be used. All guards must be bondable. All guards must wear consistent clothing that readily identifies them as contracted security force members. All guards will have the capability to communicate with the ship's Captain (via the Watch Officer) at all times. In all cases, the ship's Captain and Watch Officer will be notified of any situations threatening the safety of the ship or persons as soon as practicable. The Captain will promulgate the weapons condition of readiness and guard placement prior to the start of work. Any guidance given must comply with applicable Federal and State laws as well as installation restrictions. Within the limits imposed by the shipyard and local law, the Ship's Captain has the authority to place guards in any location deemed necessary to best protect the ship to include: Any location aboard ship, any location aboard an adjacent ship under Navy Control, or any location on an adjacent pier. Guards may be employed to work in tandem with guards from adjacent Navy controlled ships or from the adjacent shore installation as the Captain (or Officer in Charge as applicable ) deems appropriate. A Security Brief between the Captain, Shipyard Security Manager, the Commercial Security Company, and applicable local law enforcement personnel will be held prior to the posting of any guards. IN PERFORMANCE OF THIS CONTRACT, THE CONTRACTOR SHALL, AT ALL TIMES, COMPLY WITH DOD DIRECTIVE 5210.56, MSC INSTRUCTION 5530.3 SERIES, AND APPLICABLE LOCAL LAW AND REGULATIONS REGARDING THE USE OF FORCE, INCLUDING DEADLY FORCE. THE CONTRACTOR SHALL FURTHER COMPLY WITH ANY SPECIFIC GUIDANCE SET FORTH IN THIS CONTRACT THAT IS PROVIDED BY THE COGNIZANT U.S. MILITARY AUTHORITY. IN CASE OF CONFLICT BETWEEN APPLICABLE LOCAL LAW/REGULATIONS AND THE SPECIFIC U.S. MILITARY GUIDANCE, THE MORE RESTRICTIVE PROVISIONS SHALL GOVERN. IN NO EVENT IS THE CONTRACTOR AUTHORIZED TO USE MORE FORCE THAN IS PERMITTED EITHER BY APPLICABLE LOCAL LAW AND REGULATIONS, DOD DIRECTIVE 5210.56, MSC INSTRUCTION 5530.3 SERIES, OR ANY SPECIFIC U.S. MILITARY GUIDANCE SET FORTH IN THIS CONTRACT. UNDER THIS CONTRACT, THE CONTRACTOR HAS THE SOLE OBLIGATION TO ASCERTAIN AND CONFIRM ALL APPLICABLE LOCAL LAWS AND REGULATIONS WITH RESPECT TO THE POSSESSION OF ARMS AND WEAPONS AND THE USE OF FORCE, AND HAS THE SOLE OBLIGATION TO COMPLY WITH THOSE LOCAL LAWS AND REGULATIONS. NOTWITHSTANDING THE ABOVE REQUIREMENTS, IT IS UNDERSTOOD THAT CIVILIAN CONTRACT SECURITY PERSONNEL WHO ARE EMBARKED ON MSC VESSELS (I.E., ASSIGNED TO MSC VESSELS FOR SHIPBOARD SERVICE) HAVE A PRIMARY DUTY OF DEFENDING THE VESSEL'S CREW FROM ATTACK (AND INDIRECTLY THE VESSEL ITSELF IN MANY CASES, AS SOME ATTACKS ON THE VESSEL MAY THREATEN THE LIVES OF THE CREW). CONSEQUENTLY, CIVILIAN CONTRACT SECURITY PERSONNEL WHO ARE EMBARKED ON MSC VESSELS (I.E., ASSIGNED TO MSC VESSELS FOR SHIPBOARD SERVICE) ARE AUTHORIZED TO BEAR ARMS WHEN AUTHORIZED BY THE SHIP'S MASTER AND TO USE NECESSARY DEADLY FORCE IN SELF DEFENSE AND THE DEFENSE OF OTHERS IN ACCORDANCE WITH MSC INSTRUCTION 5530.3 SERIES. The following clauses and Provisions applies: 52.212-1, 52.212-3, 52.212-4, 52.212-5 (Dev), 52.232-33, 52.204-7004 Alt A, 52.252-2 CLAUSES INCORPORATED BY REFERENCE (FEB 1998) This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text.
