Description
Construction Manager as Constructor (CMc) Contract for the proposed new United States Courthouse in Jefferson City, Missouri General Information: Document Type: Synopsis. Solicitation Number: GS06P06GZC0506. Estimated Post Date: June 6, 2006. Estimated Response Date: July 25, 2006. Classification Code: Construction of Structures and Facilities. Description: The General Services Administration announces an opportunity for Construction Excellence in Public Buildings. The following document describes the Construction Manager as Constructor (CMc) Contract for the proposed new United States Courthouse, to be located in Jefferson City, Missouri. The scope includes Pre-Construction Phase Services and the option for Construction Phase Services. A Firm Fixed Price (FFP) contract for the design phase and a Guaranteed Maximum Price (GMP) , with Contingency Allowance for the Construction Phase Services Option is contemplated. The CMc will be competitively chosen using Advisory Multi-step (FAR 15.202), and Source Selection (FAR 15.3) procedures. For this contract, technical factors, when combined, are significantly more important than cost or price (see FAR 15.101-1 trade offs). Project Summary: The proposed United States Courthouse will be constructed on a site within the CBD of Jefferson City, Missouri. The new courthouse will provide the additional space needed to support the 10-year space needs of the United States Courts, which cannot be satisfied in the existing building due to structural, security, and space configuration constraints. The project consists of a new courthouse of approximately gross square meters (118,294 gross square feet), while containing useable square meters (105,694 useable square feet). The project will include 28 interior secure parking spaces and 75 exterior surface parking spaces. The United States Courts, United States District and Bankruptcy Court Clerks, United States Probation, United States Pretrial Services, Federal Public Defender, United States Marshals Service, United States Attorney, the local offices of both State Senators, and the Congressman will occupy the facility. The space will include four (4) courtrooms, two (2) District, two (2) Magistrate, and their associated supporting spaces; such as judge?s chambers, jury deliberation facilities, jury assembly/grand jury suites, holding cells, etc. Office space will be provided for the other aforementioned tenants. Occupancy is anticipated for 2nd quarter of Fiscal Year (FY) 2010. The entire facility must be substantially complete within 960 calendar days from the Notice to Proceed (NTP) of the Construction Phase Option. Project design and construction will meet, as a minimum, the Leadership in Energy Efficient Design (LEED) Silver Standard, as defined by the United States Green Buildings Council. Definition of Construction Manager as Constructor: A CMc is defined as a firm engaged under direct contract to a building owner or client, in this case the General Services Administration (GSA), to provide design review, cost estimating, scheduling and general construction services. The CMc shall be a member of the project development team during the design and construction phases, along with GSA as owner/developer and GSA?s A-E firm yet to be selected. At the time of contract award, projected to coincide with the program verification stage, the CMc?s firm price for pre-construction and pricing for construction phase services, will form the basis of the contract. In accordance with the successive targets, the CMc shall guarantee a maximum project price based on the facility described in the Government?s construction documents and Request For Proposal (RFP) package. The services requested of the CMc shall cover a wide range of design and construction activities, which are often performed by both Construction Managers (CM's) and General Contractors (GC's). In contrast to a CM that is not also a constructor, the CMc is responsible, through design review, involvement in the project development and administration of the construction, for constructing the facility described by the Government at or below the defined budget - the project Estimated Construction Cost, or ECC. Price Range: $50,000,000 to $55,000,000. Proposal Submission Requirements: Proposals will be evaluated using a two-stage, advisory multi-step process (FAR 15.202). Stage I of the RFP will contain an explanation of the entire selection process, including the evaluation factors for Stage I and Stage II of the Request for Proposals (RFP). Under Stage I, Offerors must submit information in descending order of importance regarding the firm's qualifications, past performance, past experience, proposed personnel, experience with electronic project management (e-PM), and other factors identified in the RFP. Submissions shall clearly address the rating factors identified in the Stage I RFP. The Government will evaluate Stage I of the RFP submissions to identify and advise the Offerors about their potential to be viable competitors. The Government shall evaluate all responses in accordance with the criteria stated in the Stage I of the RFP, and shall advise each respondent in writing, either that it will be invited to participate in the resultant acquisition, or based on the information submitted, that it is unlikely to be a viable competitor. The Government shall advise respondents considered not to be viable competitors of the general basis for that opinion. The Government shall inform all respondents that, notwithstanding the advice provided by the Government in response to their submissions, they may participate in the next stage of the acquisition. Offerors must submit a Detailed Project Management Plan, Oral Presentation, Price Proposals, and Subcontracting Plans (if large business) under Stage II of the RFP. All Stage II respondents shall provide a brief written narrative of their outreach efforts to utilize small disadvantaged and small women-owned businesses on this project. Small Business Participation: In accordance with the Small Business Competitiveness Demonstration Program, this procurement is unrestricted and is therefore open to both large and small business concerns. Although this procurement is open to large business, small businesses are encouraged to participate. In accordance with Public Law 95-507, the offeror will be required to provide maximum practicable opportunities for small, disadvantaged, veteran owned, service disabled veteran owned and HUBZone businesses through subcontracting opportunities. In the event a large business (small businesses are not subject to this requirement) is the awardee, an acceptable subcontracting plan must be reviewed and approved by SBA prior to award of this contract. Large businesses shall be required to demonstrate a proactive effort to have participation from small (50%), small disadvantaged (8%), small women-owned (5%), small HUBZone (3%) small veteran-owned (5%) and Service Disabled Veteran-Owned Small (3%) business concerns. The North American Classification System (NAICS) for this project is 236220. Large businesses shall be required to demonstrate a proactive effort to achieve the above minimum goals for all subcontracted work. An acceptable Subcontracting Plan shall be agreed upon prior to contract award to any large business (small businesses are not subject to this requirement). Offers from Hub Zone small business concerns will receive a price evaluation preference per FAR 19.13. FAR Clause 52.219-4 - Notice of Price Evaluation Preference for Hub Zone Small Business Concerns shall apply. The Stage II evaluation will be based on technical factors as well as price. The Government reserves the right to make an award based on the evaluation of the Stage II submittals without holding discussions. After technical and price evaluations, discussions and/or negotiations and Final Proposal Revisions, if required, the Source Selection Evaluation Board (SSEB) will make recommendation to the Source Selection Authority (SSA) of the offeror whose proposal is most advantageous to the Government. Source Selection Evaluation Criteria (The following criteria represent the Stage I factors that will be used by GSA?s SSEB in descending order of importance): 1) Past Performance in Providing Construction Manager or General Contractor and Pre-Construction Services on Similar Projects; 2) Qualifications and experience of Key Personnel; 3) Experience in Same or Similar Geographic Areas; 4) Experience with Building Owner as Full Partner; 5) CMc?s Use of Current Electronic Project Management Technology 6) Experience in Use of Alternative Dispute Resolution Pre-Proposal Conference: A Pre-Proposal Conference will be scheduled and posted in FedBizOpps in June 2006 in Jefferson City, Missouri. How to Request a Copy of RFP: The RFP will be available from the General Services Administration through a link on the GPE the GPE (FedBizOps). All responsible sources may submit a proposal, which will be considered by the agency. The solicitation will be available through the Federal Technical Data Solution (FedTeDS) website (fedteds.gov). FedTeDS is a secure website designed to safeguard sensitive but unclassified (SBU) acquisition information. It is fully integrated with other electronic government initiatives such as FedBizOps and the Central Contractor Registration (CCR) database, and is available for use by all Federal agencies. At a minimum all vendors must supply the following information: Your Company Central Contractor Registration (CCR) Marketing Partner Identification Number (MPIN) (You can get this from you company CCR Point of Contact), Your Company DUNS Number or CAGE Code (Contact Dun & Bradstreet at 1-800-333-0505 if you do not have a D&B Number), Your Telephone Number, and Your Email Address. Once you have registered with CCR you will be required to register with FedTeDS. No federal material can be downloaded until you have registered under both sites. You may access FedTeDS via the following address www.fedteds.gov. You will then be required to access the vendor registration form by selecting the hyperlink entitled REGISTER WITH FEDTEDS and then choosing the VENDOR REGISTRATION FORM hyperlink. It is the vendor?s responsibility to monitor FedBizOps for any changes and/or conditions. Any offeror submitting a proposal is required by the Federal Acquisition Regulations to use the Online Representation and Certifications Application (ORCA). ORCA is a web-based system that centralizes and standardizes the collection, storage and viewing of many of the FAR required representations and certifications previously found in solicitations. With ORCA you now have the ability to enter and maintain your representation and certification information, at your convenience, via the Internet at http://orca.bpn.gov. To register in ORCA, you will need to have two items: an active Central Contractor Registration (CCR) record and a Marketing Partner Identification Number (MPIN) identified in that CCR record. Your DUNS number and MPIN act as your company?s ID and password into ORCA. The basic information provided in your CCR record is used to pre-populate a number of fields in ORCA. Once in ORCA you will be asked to review pertinent information pre-populated from CCR, provide a point of contact, and answer a questionnaire that contains up to 26 questions. The questionnaire is to help you gather information that you need for your clauses. The questionnaire is not the official version. Be sure to read the provisions carefully. The answers you provide are then automatically entered into the actual FAR provisions. You are required to review your information, as inserted, in context of the full-text provisions for accuracy; acknowledge three additional read-only provisions; and click a time/date stamp before final submission. You will need to review and/or update your ORCA record when necessary, but at least annually in order to maintain active status.
