- (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This notice constitutes the only solicitation, and written copies of this solicitation will not be provided. Quotes are being requested. FOB Destination. The Government intends to award a Firm Fixed Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) contract under Simplified Acquisition Procedures (SAP) using FAR Part 13. (ii) The solicitation number is HSCEOP-06-Q-00063. This requirement is issued as a Request for Quote (RFQ) (iii) This RFQ and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-09. (iv) This solicitation is being issued as a 100% small business set-aside. (vi) 1. PERFORMANCE WORK STATEMENT 1.1 OBJECTIVE The Office of Investigations (OI) has a need to purchase foreign language testing services for Headquarters, the Special Agent in Charge (SAC) and International Affairs (IA) offices for law enforcement officers within the meaning of 5 U.S.C. section 8331(20) (Civil Service Retirement System law enforcement definition) or 5 U.S.C. section 8401(17) (Federal Employees Retirement System law enforcement definition), also known as 6(c) and 12(d) retirement, respectively. These law enforcement officers will be proficient in and utilize a foreign language in the performance of their official duties. 1.2 SCOPE OF WORK The contractor will provide oral foreign proficiency tests. The proficiency tests will be given orally over the phone at an average rate of about 200 tests per month not to exceed the contract ordering limit. The proficiency tests will be based on the United States Government Interagency Language Roundtable (ILR) (www.govtilr.org). The level of proficiency description will be specified and scored as follows: (S2) Limited Working Proficiency, (S2+) Limited Working Proficiency plus, (S3) General Professional Proficiency, (S3+) Professional Proficiency plus, (S4) Advanced Professional Proficiency, (S4+) Advanced Professional Proficiency plus, (S5) Functional Native Proficiency 1.3 TASKS The Contractor will conduct the foreign language proficiency tests over the telephone with law enforcement officers stationed at ICE Headquarters as well as SAC and IA offices. The Contractor will only allow WM approved applicants to sign up and test. The Contractor will provide Workforce Management Unit (WM) with access to a secure website that contains the following information: Last and first name of law enforcement officers, Badge Number, Date of Birth, Language Tested, Score, Date of Test. This information must be downloadable into a Microsoft Excel Spreadsheet from the internet. The languages REQUIRED are: SPANISH*, Afrikaans, Albanian, Amharic, Arabic Armenian, Bulgarian, Cantonese, Cebuano, Chavacano, Croatian, Czech, Dari, Dutch, Egyptian, Filipino, Flemish, FRENCH*, GERMAN*, Georgian, Modern Greek, Haitian Creole, Hebrew, Hilgaynon Hindi, Hmong, Ilokano, Indonesian, Italian, Japanese, Javanese, Khmer, Korean, Malay, MANDARIN*, Norwegian, Pashto, Persian Farsi, Polish, Portuguese, Punjabi, Romanian, RUSSIAN*, Samoan, Serbian, Slovak, Swahili, Swedish, Tagalong, Tamil, Tausug, Thai, Turkish, Ukrainian, Urdu, Vietnamese COMMON LANGUAGES in CAPITAL LETTERS* The Contractor will schedule exams within the timeframe listed below: Common Languages: 24 ? 72 Hours and All Other Languages: 72 ? 120 Hours The scheduling of foreign language tests will be done directly by the law enforcement officers via the contractor?s secured website. The Government will provide the law enforcement officers with the necessary information to access the Contractor?s website. Upon the establishment of the test date and time the Contractor will provide the law enforcement officer(s) with a telephone number to be used for the test. 1.4 TESTING REQUIREMENTS The Government shall be able to cancel a test without charge with 24-hours notice prior to the set test time. The Contractor must provide WM with an email confirming test cancellation. WM will have access to the cancellation information on the Contractors website. Proficiency tests must be administered as close as possible to the law enforcement officer?s basic workweek based on Eastern Standard Time at a government work site. The website must be customized so that law enforcement officers can locate the equivalent test time in his/her time zone. The contractor must establish appropriate means to verify and document the identity of the employees tested based on their Name, Badge Number, and Date of Birth. The contractor will, in turn, ensure this information on ICE agents is kept secure and not disseminated to anyone. Contractor will provide a secure website that includes: Agent access to register for testing, and controlled access by WM personnel to view test results/scores. Contractor will score test using the Interagency Language Roundtable Language Skill Level Descriptions. Tests scores will be available to WM personnel on a secure website within 24 hours of the completed test. 1.5 DELIVERABLES / SCHEDULE Deliverables prepared and delivered under this contract are identified below: 1) Test Results - Accessible through a secured website within 24 hours after completion of tests 2) Archived test results in Excel spreadsheet covering the current contract year period of performance - Annually 1.5.1 DOCUMENTATION All documentation developed by the Contractor must become the property of the Government and must not contain proprietary markings. The Contractor must retain all test results for a minimum of three (3) years. 1.6 GOVERNMENT FURNISHED INFORMATION On a monthly basis, the Government will provide the Contractor with an Excel Spreadsheet (electronically) with a list of management approved applicants for testing. (ix) 52.212-2 Evaluation?Commercial Items (Jan. 1999) - The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: 1) The Offerors Technical Capability to meet the requirements of the PWS in this solicitation including: a) Testers Certification by the ACTFL Oral Proficiency Tester, and b) Membership in the American Council on the Teaching of Foreign Languages. 2) Price, and 3) Past Performance ? Offerors shall submit (3) three references from the same or similar work to include Points of Contact ? Name, Phone Number, and Email Addresses. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer?s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (x) ONLINE REPRESENTATION AND CERTIFICATION APPLICATION (ORCA) The Federal Acquisition Regulation was recently amended to require offerors complete Representations and Certifications through ORCA at least annually as of January 1, 2005.
