Description
US Customs and Border Protection (CBP) intends to negotiate, on a sole source basis, under authority of FAR 6.302-1(2)(A)(ii) with Pacific Applied Technology, Inc. of Vancouver, WA for PAT software license renewals in support of CBP?s existing Treasury Enforcement Communications System (TECS), which also provides interactive interfaces to multiple other Criminal Justice and Law Enforcement Systems. These interfaces are accomplished using proprietary software that is maintained and owned by Pacific Applied Technology, Inc. (PAT) of Vancouver, Washington. Title to, and ownership of, all PAT package programs, macros, methodologies, modules, associated documentation and potential future modifications (irrespective of their authorship), including all copyrights therein for CBP?s system, are the exclusive property of PAT. ***Sole Source determination is based on the need for the PAT software renewals to maintain absolute compatibility with other law enforcement systems and maintain CBP?s TEC System?s functionality and capabilities. It is mission critical that there be no break in service or incompatibility between systems. ***Delivery shall be FOB Destination, Washington, DC, and is required within 30 days after receipt of order. ***The North American Industry Classification System (NAICS) code for this acquisition is 511210 and the size standard is 23 million dollars. **The Government intends to solicit and negotiate directly with Pacific Applied Technology, Inc. No solicitation package will be issued. This notice of intent is not a request for competitive proposals. However, if any interested party believes it can meet the above requirement, it may submit a statement of capabilities. The statement of capabilities must be submitted in writing and must contain material in sufficient detail to allow the Government to determine if the party can perform the requirement. A determination to compete this action based on the responses received is in the sole discretion of the Government. All interested parties must express their interest and capabilities in writing via mail, facsimile, or email. Documents over 10 pages total will not be accepted by facsimile. Verifications of receipt of responses are the sole responsibility of the contractor. If no responsive statements are received by August 24, 2006 at 12:00 pm EST, an award shall be made to Pacific Applied Technology, Inc.
