Description
This is a combined synopsis/solicitation for sewage services in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items as supplemented with additional information included in this announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. RFP-RBK-0019 is issued as a request for proposal. The solicitation document and incorporated provisions are those in effect through Federal Acquisition Circular 2005-12. The North American Industrial Classification System Code is 221320 - Sewage Treatment Facilities. The small business standard is $6.5 Million. The Government intends to make a single award of a firm fixed price contract. Award will be made to the responsible offeror who submits the most advantageous offer to the Government based on price. SEWAGE TREATMENT SERVICES: GENERAL REQUIREMENTS: The Federal Bureau of Prisons, Field Acquisition Office, Grand Prairie, Texas intends to award a contract for the provision of sewage treatment services. Services will be rendered on-site at a federal prison. General information regarding the Bureau of Prisons (BOP) and its facilities is located at www.bop.gov. REQUIRED SERVICES/STATEMENT OF WORK: 1. Required Services: (a) The contractor shall provide sewage treatment services to the Bureau of Prisons - Federal Correctional Institution (FCI), located in Ray Brook, New York. (b) The estimated annual sewage volume, based on quarterly readings of a water meter is 113,653,974 gallons. This annual volume is an estimate and is merely information and is in no way to be construed as a guarantee. (c) The contractor shall operate and maintain facilities necessary for the proper collection, treatment and disposal of all sewage and waste originating from FCI, in compliance with all applicable laws, rules, permits, and regulations promulgated by any and all government authorities having jurisdiction. 2. Point of Delivery: The contractor shall provide the aforementioned sewage services by collecting, treating and disposing of all sewage and waste water originating from FCI. 3. Billing Schedule: (a) Quarterly sewage service charges billed to FCI under this contract shall be computed based upon quarterly readings of the water meter for FCI's usage. Calculations shall be based on total sewage plus actual water usage for FCI, or until a sewage meter is installed by FCI to measure the exact quantity of sewage originating from FCI. (b) The contractor hereby represents and warrants to the Government that the cost of service to FCI under the rate schedule is not in excess of the service cost under any other rate schedule now available to present and prospective customers of the same class under like conditions of use and service, and agrees that during the life of this contract the Government shall continue to have available to it the lowest cost applicable rate schedule for customers of the same class under like conditions of use and service. 4. Invoice procedures: Invoice for sewage services shall be submitted to FCI on a quarterly basis. 5. Capital Costs: All costs related to any further design, construction and/or improvements of the FCI sewage line to the contractors sewage system, including the pumping station, and the service and maintenance of that line and pumping station, shall be negotiated by all parties to ensure equitable responsibility. 6. Maintenance: (a) FCI agrees to operate and to pay all maintenance costs of its sewage line while it is in operation, and to give at least 6 months notice to the contractor in the event FCI elects to terminate use of the sewage line operation. Upon a decision to terminate use of the sewage line, FCI agrees to provide for and pay all costs and expenses directly associated with the termination of the sewage line operation. (b) The contractor agrees to operate, provide all maintenance and maintain the sewage treatment plant in such a manner as to provide for the adequate treatment of sewage emitted from the FCI sewage line, subject, however, to certain terms and conditions hereinafter stated. 7. Annual Treatment Charges: The contractor reserves the right to reasonably increase FCI's annual sewage treatment fee commensurate with any reasonable increase in the base rate charged by the contractor to residents residing within the limits of the service territory. 8. Sewage Treatment: (a) The contractor agrees to permit the continuance of the tie-in connection of the FCI sewer line to the contractor sewer system. (b) The Contractor agrees to accept and treat the sewage emitted from the FCI sewage line. 9. Limits on Responsibility of the Contractor: (a) The contractor shall incur no liability either to FCI, or to any other person or entity, for or on account of any event caused in whole or in part by the following; (1) Act of God, war, insurrection, riot, strike, or labor slowdown or job action; (2) any decree, edict, regulation or order issued by any agency, (State or Federal), court, bureau, board or legislative body having jurisdiction and which affects the operation of the sewage disposal plant or any of its lines, systems or other equipment; and (3) any other condition, cause or event not within the control of the contractor. (b) The contractor shall take reasonable care and prudence in the operation and maintenance of the plant but shall incur no liability either to FCI or to any person or entity by reason of any breakdown or failure occurring at any time or times in any part of the system resulting in a loss of service. 10. Special Provisions Respecting Sewage Line and Pumping Station: (a) Chlorination: The sewage line and pumps shall continue to be operated and maintained by FCI so as to permit chlorination or other methods of disinfection and odor control. Any such methods must be approved by the contractor. (b) Shut-off Valves: FCI shall maintain two (2) shut-off valves, one immediately after the pumps at FCI and the other just prior to the connection with main. 11. Special Responsibilities of FCI: (a) FCI shall not permit any industrial waste, industrial sewage, or any other type of material which is or might be harmful to the contractor disposal system, to be introduced into the lines or any part of the system under its control. FCI shall abide by all provisions of the local Sewer Code. (b) FCI shall exercise all necessary precautions to see to it that the sewage in its part of the lines shall not become septic, including the making of regular and systematic checks to determine if such septic condition develops. If such condition does develop, FCI shall forthwith take all necessary measures and procedures to remove the septic material and sanitize the lines by chlorination or other acceptable methods. (c) FCI shall notify the contractor of any other situation or condition which might in any way imperil or endanger the sewer system, treatment plant or contractor personnel, occurring on their portion of the system, and immediately take whatever steps may be necessary or proper to correct the problem. 12. Right of Inspection: (a) The contractor shall have the right to inspect any part of the sewage disposal system of FCI. Requests for inspection to be made 48 hours prior to inspection in order to allow time for completion of security clearance procedures, and to ensure the availability of a Facilities staff member familiar with the sewage system. 13. Specifications, Maps and Diagrams: Upon request, the contractor may view any drawings or maps of the FCI sewage system. Copies of maps or drawings will not be permitted to leave the institution due to security measures. FCI shall make all reasonable efforts to provide all requested documents. 14. Conservation Measures: If at any time, in the opinion of the contractor, the sewer system or any portion thereof, is or is likely to become overburdened, the contractor may request all consumers to exercise such reasonable conservation measures as will alleviate or cure the problem. FCI agrees when such request is made it will take such steps to curtail its usage as may reasonably be undertaken and thereby contribute to the solution of the problem. This effort shall be made taking into consideration the FCI must maintain a secure and safe facility at all times. Place of Performance - Contract services will be provided to the Federal Correctional Institution (FCI) Ray Brook, 128 Old Ray Brook Road, PO Box 300, Ray Brook, NY 12977-0300. Performance Schedule - The contractor shall perform all services as described in the Statement of Work, 24 hours a day, seven days a week, and as required to meet all requirements. Period of Performance - This contract shall be for a period of 10 years from the effective date of award. Payment Terms - It is the preference of the FCI to be billed on a quarterly basis. Invoices should be submitted in accordance with FAR 52.212-4(g) and payment will be rendered in accordance with the Prompt Payment Act (31 U.S.C. 3903). The contractor may offer discount payment terms for prompt payments. Contract Pricing - Contract pricing shall include all charges to the Government for performing the services required by this solicitation/contract (e.g., bonding, overhead, profit, supervision, minimum wages, etc.). The Government reserves the right to award without discussion. Therefore, the initial offer should contain the offer's best terms from a cost or price standpoint. Pricing Methodology - The quantity of services to be provided by the Contractor is estimated in the Required Services/Statement of Work section of this solicitation. The elimination of these clauses by reason of such repeal, revocation, or dissolution shall not affect the continuing validity and effectiveness of the remainder of the contract or other clauses referenced above.
