- This is a modification to the combined synopsis solicitation dated 17 July 2006 as below. 1. The purpose of this modification is to a) answer questions from proposed offerors; and b) incorporate the site visit questions and answers. a) Questions from Proposed Offerors: i. Are we allowed to bid if our product has a patent? What does it mean by 'Gov't must have ability to obtain an unrestricted license under DFARS Clause 252.227-7015' which states the Gov't shall have unrestricted right to use, modify, reproduce, etc.? Doe s that mean the Gov't 'owns' our submitted product and, with their own discretion, can have it reproduced by themselves or by someone else? Answer: The contractor may submit an offer, but if he does so, his price will be deemed to include a license to the gov't to use any of his proprietary data regarding the item to reprocure the item competitively in the future, and the contractor may not put any re strictive markings in his proposal that would in any way conflict with the granting of such a license. So, really the offeror doesn't have to do anything but submit a proposal and avoid restrictive markings. His offered price would then include a license for the gov't to use his data to reprocure the item competitively in the future. We don't 'own' the item or even the rights to the item or the data rights to the item. We merely then own an unrestricted license to use the offeror's data to reprocure the item in the future competitively--i.e, if the offeror does not win the future compe tition, another firm who does would have the right to manufacture the item using those data, but only under contract with the US Gov't. ii. Is there legal/official documentation (declaring patent indemnity) required with our submitted quote if our product has a patent? Does a patent indemnity to the US Gov't allow another company to copy or use our patented product? Answer: These questions are in regards to patent indemnity and you must seek own legal advice. iii. Is the customer sure they want the product to pass California Tech Bulletin 133 Flammability requirements? This would significantly raise the cost. In the past the customer has only required the standard CAL 117 requirement. Answer: New standards require the increase testing of California Tech Bulletin 133 or its equivalent for the furniture. iv. In reviewing the above listed solicitation we noticed in the requirements that 'all parts including the cushions except the main frame shall be interchangeable with the sofa's presently on hand'. In order to be sure our product meets this requirement we would like to know the manufacturer and the model number of the sofas that you currently use. If you could please provide us with this information it would be a tremendous help. Answer: The specifications are generalized. There is no manufacturer and model number. The site visit was conducted to answer any questions on interchangeability. b) Questions from Site Visit: i. Does the sofa and chairs have to be exact fabric pattern? Answer: Yes. The fabric is Riverbed, color: Multi # 915101, grade 2, 100% Polyester ii. Do all the pieces of the sofa have to be completely interchangeable with current inventory? Answer: No. Interchangeability is required for size/dimension of all individual pieces, cushions and covers with current inventory. Construction mechanisms/Main frame need not be interchangeable with current inventory. NOTE: THIS NOTICE WAS NOT POSTED TO FEDBIZOPPS ON THE DATE INDICATED IN THE NOTICE ITSELF (17-AUG-2006); HOWEVER, IT DID APPEAR IN THE FEDBIZOPPS FTP FEED ON THIS DATE.
