Description
Notice of Proposed Contract Action Synopsis. There is no solicitation available at this time. Requests for a solicitation will receive no response. This Proposed Contract Action is published to notify potential sources of the Government’s intent to modify the existing sole-source contract awarded to Johns Hopkins University Applied Physics Laboratory (JHU/APL) by adding additional performance periods. The resultant contract extensions will be Cost plus Fixed Fee (CPFF) for up to an additional twenty-four months for a total contract performance period of five (5) years. The North American Industry Classification (NAIC) Code is 517910 “Other Telecommunications”. On 28 Dec 2005, the Government provided notice for an anticipated follow-on contract. The information received from the previous notice provided valuable information and will be utilized to support the Market Research requirements imposed by FAR 5.201. Several interested parties responded with an expressed interest to provide the services specified and provided capabilities briefings to demonstrate their knowledge and expertise. The capabilities briefings afforded the opportunity for information exchange between the parties, for which the Government could express the unique circumstances surrounding the MSX program and its resources (i.e. 10 meter dish, acquiring associated peripheral equipment/services and the budget/financial issues). As a result of this exchange, the Government decided based upon responses from the potential offerors expressing an interest, that the cost/schedule and performance period contemplated presented too great a risk and too little time for offeror’s to recoup their initial investment in this endeavor. Based upon the information contained herein, the Governments supports the findings specified in FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. Therefore, the Government intends to solicit and negotiate with only one source, the incumbent contractor, JHU/APL, pursuant to the authority of 10 USC 2304 (c) (1). A contract modification is contemplated for the continuance of supplies and services utilizing the existing contract under the original terms and conditions and shall not exceed the statutory performance period imposed by law for service contracts.
