Description

The statutory authorities for this acquisition as a sole source are 41 USC 253(c)(1) - Only one responsible source and 41 USC 253(c)(2) - Unusual and compelling urgency. The Office of Trademark Quality Review and Training has utilized the e-learning system in this acquisition request for over four years to great success. The e-learning modules supported by this system have been authored on proprietary software owned by the requested source and are not transferable to another source. As the need for continuing access and use of these modules is essential to the mission of training trademark examining attorneys and others within the Trademark Office, loss of this source would require re-authoring the modules and would be burdensome and inefficient at best and otherwise damaging to the agency. Use of the current source is further warranted as the current contract with the source has lapsed and therefore must be renewed or face immediate loss of the ability to utilize the e-learning modules already authored. These modules are essential to the training of new trademark examining attorneys as well as others within the Trademark Office. This is an unusual and compelling urgency, as 60 or more new trademark examining attorneys in Fiscal Year 2007 will require the training provided through the current source, as will other current employees. The use of the e-modules in part fulfills the Trademark Office?s responsibilities under the current Strategic Plan.
