- Notice of Intent to award a Sole Source Procurement. The Government intends to issue a sole source purchase order for maintenance and service of a Zeiss 532/YAGII Plus Laser unit to Carl Zeiss Meditec, Inc, 5160 Hacienda Drive, Dublin CA 94568. The Maintenance Support needs to be maintained in order for it to keep supporting 55th Medical Groups mission. The 55th Contracting Squadron intends to award a purchase order by other than full and open competition in accordance with Subpart 6.302-1 (a)(2)(ii). Only one responsible source and no other supplies or services will satisfy agency requirements. This notice is not a request for competitive proposals. A determination not to compete this proposed procurement was made because Carl Zeiss Meditec, Inc. is the manufacturer of the equipment and is currently the only known authorized company to do required maintenance and service. The procurement of this maintenance for the hardware and software support must be completed in a timely manner in order to meet mission requirements. Questions should be directed to SSgt Jason M. Agency and contracting activity (FAR 6.303?2(a)(1)) 2. Nature and/or description of the action being approved (FAR 6.303?2(a)(2)) Request approval to use other than full and open competition procedures to solicit a contract for maintenance service 3. Supplies or services required to meet the Agency needs (including estimated value) (FAR 6.303?2(a)(3)) Contractor to provide all transportation, labor, tools, test equipment, service literature, and parts except therapy laser tubes, therapy laser diodes, therapy laser head assemblies, and fiber optics that are necessary to perform scheduled maintenance/calibration inspection and unscheduled maintenance or repair on the following piece of medical equipment. Statutory authority (FAR 8.405?6) 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will satisfy Agency Requirements. 5. The proposed contractor's unique qualifications require use of the authority cited above (FAR 6.303?2(a)(5)) Carl Zeiss is only qualified, service company for this item. This equipment is necessary to meet the minimum requirements of the government to provide laser for all qualified beneficiaries. No other service agencies are available. Carl Zeiss is the original equipment manufacturer and controls proprietary information and parts on their unit. 6. Description of efforts to ensure that offers are solicited from as many potential sources as practicable (FAR 6.303?2(a)(6)) The maintenance service for this item is proprietary and no other local company can provide this service. We performed web based research and could find no third party companies that offered maintenance services for the Visulas 532 Combi Laser 7. Determination of fair and reasonable cost (FAR 6.303?2(a)(7)) The price is fair and reasonable based on comparison of the cost of similar maintenance agreements for similar medical equipment. Carl Zeiss is a highly reputable company which has Federal Supply Schedule V797P-3402K. 8. Market survey (FAR 6.303?2(a)(8)) The maintenance service for this item is proprietary and no other local company can provide this service. We performed web based research and could find no third party companies that offered maintenance services for the Visulas 532 Combi Laser 9. Other facts supporting the use of other than full and open competition (FAR 6.303?2(a)(9)) The purchase of this service contract is necessary to meet the minimum requirements of the government to perform ophthalmic laser services to meet mission requirements. Failure to acquire these services will result in the Opthalmology Clinic not being able to provide proper treatment to approximately 75 patients per year. 10. List of sources, if any, that expressed a written interest in the acquisition (FAR 6.303?2(a)(10)) Carl Zeiss Meditec, Inc. 11. Actions, if any, that are being taken to remove and overcome any barriers to competition before any subsequent acquisitions for the supplies or services required (FAR 6.303?2(a)(11)) For future acquisitions of medical equipment service contracts, a detailed market survey will be conducted in an attempt to locate new medical equipment service agencies that are 100% qualified to perform required services. 12. Contracting Officer certification (FAR 6.303-2(a)(12)) I certify, by signature, that the facts and representations under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief. 13. Technical requirements personnel certification (FAR 6.303?2(b)) I hereby certify that this justification and approval for other than full and open competition is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge and belief, and that I would not be making this request if it were feasible to fully compete this requirement. I further certify that this request is not the result of lack of advanced planning or a desire to expend funds while those funds are still available.
