- The purpose of this modification is to reflect that this action will be processed in accordance with FAR Part 12 - Acquisition of Commercial Items. This is a notice of intent to award a sole-source contract pursuant to FAR Part 12 ??? Acquisition of Commercial Items, and is not a request for competitive proposals. The U.S. Department of Energy (DOE) intends to solicit a proposal and negotiate a sole source contract with L3 Communications to provide the Office of Security and Safety Performance Assurance (SSA) with an extended maintenance agreement for X-Ray machines provided by L3 under a previous contract. The contactor will be required to perform preventative/routine maintenance, and repair at the DOE Headquarters facilities, in Germantown, MD and Washington, DC. The statutory authority for permitting other than full and open competition for this contract is Section 303[c][1] of the Federal Property and Administrative Services Act of 1949, as amended by the Competition in Contracting Act, 10 USC 2304[c][1], and implemented by FAR 6.302-1[b][2] which authorizes other than full and open competition when there is only one responsible source and no other supplies or services will satisfy agency requirements; when the existence of limited rights in data, patent rights, copyrights, or secret processes; the control of basic raw material; or similar circumstances, make the supplies and services available from only one source. Firms who want to challenge the sole-source must submit an interest letter that demonstrates the firm's ability to provide the above services. Interested parties may submit a proposal and rationale as to why they should be considered within ten (10) days of this notice via the Department of Energy "Industry Interactive Procurement Systems" (IIPS) at the following Internet address http://doe-iips.pr.doe.gov/. Vendors must register via the IIPS web site prior to responding to this market survey. Instructions on how to submit your response can be found in the document, which is located at http://doe-iips.pr.doe.gov/. For technical assistance firms should call 1-800-683-0751 or email the IIPS administrator at iips@pr.doe.gov. Any adjustments to the acquisition strategy for this proposed contract based upon responses to this notice is solely within the discretion of the Government. The North American Industry Classification System (NAICS) Code for this requirement is 811219. The anticipated period of performance of this contract is for a total of three years, consisting of one 12-month base period and two 12-month option periods. ***See Numbered Note 22.
