Description
The National Cancer Institute (NCI), Center for Cancer Research (CCR), Pediatric Oncology Branch (POB) plans to enter into a sole source procurement for an ACEA RT-CES2-16X Analyzer from ACEA Biosciences, Inc., 11585 Sorrento Valle Road, Suite 103, San Diego, CA 92121-1310. The North American Industry Classification System Code is 334516 and the business size standard is 500 employees. This acquisition will be processed under FAR Part 12 ? Acquisition for Commercial Items and will be made pursuant to the authority in FAR 13.5 to use simplified procedures for commercial acquisitions. ACEA Biosystems is the only source known to the NCI researcher that makes real-time measurements based on impedance that integrates with currently available tissue culture systems which is required for their research and detailed below in their JOFOC. However, if any interested party believes it can perform requirement as detailed in the JOFOC they may submit a statement of capabilities. The statement of capabilities and any other furnished information must be in writing and must contain material in sufficient detail to allow the NCI researcher to determine if the party can perform this requirement. An original and one copy of the capability statement must be received in the contracting office by 1:00 pm EDT, on September 13, 2006. Faxed and emailed capability statements are NOT authorized. It is the vendor?s responsibility to call (301) 402-4509 and verify that questions were received. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. In order to receive an award from the NCI contractors must be registered in the Online Representations and Certifications Applications (ORCA). JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Part I: Background information and Description of Acquisition Title: RT-CES2-16X Analyzer Purpose/Brief History: The POB performs research in the general area of cancer research, including assessments of cell growth, differentiation, morphology, cell activation, tumorigenicity and effects of various therapeutic agents on the growth of tumor cells in vitro. Real-time assessments of the response of cells to various conditions is essential in determining the efficacy of a given treatment and establishing critical time points at which molecular mechanisms regulating survival and death may be operant. The RT-CES2-16x Analyzer from ACEA Biosciences offers a label-free, real-time assessment of cell survival, death and response to various biologic response modifiers. The measurement process is automatic, simple, homogeneous, non-invasive, and free from the use of all labels and reporters. Each well incorporates a gold circle-on-line microelectrode array. Since 80% of the bottom of the well is covered by the electrode, measurements accurately represent the behavior of all cells present. Well to well CVs are typically around 10%. When a mild alternating current is passed through the electrode array it is possible to measure the impedance of the circuit. The impedance (and calculated Cell Index) varies as the cells change over time. The cells can be observed in a microscope at any stage of the experiment. The sensor analyzer and software control the signal generation, plus data acquisition and analysis. The assay format is based on a standard 96 well plate. The instrument will accommodate up to six 16 well plates. This machine fits into standard laboratory incubators. Many biological events can be studied based on these measured changes in impedance as cells grow on the microelectrode array they include: cell proliferation, cell growth rates, cell viability, cell morphology, cell adhesion, cell motion, cell differentiation, apoptosis, cytotoxicity, viral infection, cell activation, GPCR activation, receptor tyrosine kinase activation, cell transfection, etc PART II: Facts and reasons to Justify Other than Full and Open Competition Statutory authority FAR 13.106(b)(1) b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization). Justification: The POB is proposing to procure the RT-CES2-16X system because it is the only machine that makes real-time measurements based on impedance that integrates with currently available tissue culture systems. No other system has the versatility to assess the dynamic range of cell functions as the RT-CES2-16X.
