Description
Notice of Intent to Conduct a Sole Item/Sole Source Procurement for an unlimited number of permanent licenses for use of the GoldSim software package This is a Notice of Intent to Conduct a Sole Item/Sole Source Procurement. Therefore, a solicitation will not be available, and proposals will not be accepted. The U.S. Department of Energy, National Office of Civilian Radioactive Waste Management (OCRWM) intends to procure, on a sole item/sole source basis, for an unlimited number of permanent licenses for use of the GoldSim software package (a sole item) from GoldSim Technology Group LLC (GTG), 22516 SE 64TH PL STE 110, Issaquah, WA 98027-5379 (a sole source) to satisfy requirements of the OCRWM. OCRWM has determined that GoldSim software package is the only item capable of meeting OCRWM mission requirements, and GoldSim is the only firm capable of providing this product. This procurement is a Small Business Set-Aside, and GoldSim is a Small Business under North American Industrial Classification Code 423430 with a size standard of 500 employees. The OCRWM decision to select GoldSim is based on OCRWM in 2000 negotiated a term license agreement with Golder Associates Inc. (GAI) which provided access to licenses to use the GoldSim software for all participants in and regulators of the Yucca Mountain Project (YMP). In 2004 GoldSim Technology Group LLC (GTG) acquired all of the proprietary rights to the GoldSim software and assumed GAI???s rights and obligations under the OCRWM agreement. Accordingly, the OCRWM intends to conduct this sole item/sole source procurement under authority of Federal Acquisition Regulation (FAR) 6.302-1 and no other sources will be considered. A public solicitation will not be available. This notice satisfies the requirement of FAR Part 5 for publicizing contract opportunities. The acquisition is expected to extend over a five year period. Any questions or comments pertaining to this action shall be faxed to (702) 794-5557, Attn: Maria R. Barela, OCRWM Contract Specialist, not later than September 21, 2005. THIS NOTICE OF INTENT DOES NOT CONSTITUTE A REQUEST FOR A FORMAL PROPOSAL OR A PRESOLICITATION NOTICE. This notice is provided as information to the marketplace in accordance with FAR Part 5. All feedback received will be taken into consideration, however the agency reserves the right to not utilize the comments or any other information provided. This notice in no way obligates the Government to award any contract. OCRWM will not be responsible for any costs incurred by responding to this Notice. NO SOLICITATION EXISTS AT THIS TIME.
