- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, in conjunction with FAR 13.5, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number is 1069-6G7111 and is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 05-09. The associated North American Industrial Classification System (NAICS) code for this procurement is 332995 with a small business size standard of 500 employees. This requirement is a [ Small Business ] set-aside and only qualified offerors may submit a quote. The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on Monday, September 18, 2006 at 15:30:00 Eastern Time or as otherwise displayed at www.FedBid.com. FOB Destination shall be Springfield, VA 22153 The Department of State requires the following items, EXACT MATCH ONLY, to the following: LI 001, SIG P229R Compact Semi-Auto Handgun calibur 9X19mm (Pmm NATO) Nitron Black Matte Finish, Integral Picatinny Style accessory rail, (3) 13rd Law Enforcement Magazines, TRIJICON Night Sights, Lockable case, Gun Lock, Manual, 90, EA; For this solicitation, Department of State intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing quotes, which descend in price during the specified period of time for the aforementioned reverse auction. Department of State is taking this action in a an effort to improve vendor access and awareness of requests while expediting its ability to gather multiple, completed, real-time offers. All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their offer using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make an offer on www.FedBid.com. Offerors that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. Offerors may not artificially manipulate the price of a transaction on www.FedBid.com by any means. CCR Requirement - Company must be registered on Central Contractor Registration (CCR) before an award could be made to them. The following FAR clauses in paragraph (b) of FAR clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, will apply: 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. The full text of a FAR clause may be accessed electronically at http://www.acqnet.gov/far. The selected Offeror must comply with the following commercial item terms and conditions. FAR 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition. The selected Offeror must submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items. FAR 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. FOB DESTINATION CONUS In addition to providing pricing at www.FedBid.com for this solicitation, each Offeror must provide any required, NON-PRICING responses (e.g. technical proposal, representations and certifications, etc.) no later than the closing date and time for this solicitation. Bids must be valid for 30 days after close of competition. No Exceptions or Qualifications. It is required that the Sig Sauer P229 Pistol be purchased to issue to the agents who will be assigned to overseas Posts. This will enable the agents to provide continued protection and security for personnel. Additionally, continued safe travel and protected movement is required for high level U.S. Embassy and Consulate officials while traveling overseas, and for Ambassador level officials serving in international organizations working to restore and maintain economic and social stability. Sig Sauer P229 9mm pistol is the issued pistol that all agents are trained on. Overall length: 7.1 inches, Overall height: 5.4 inches, Overall width: 1.5 inches, Barrel length: 3.9 inches, Weight w/o mag: 28.1 oz, Mag weight: 3.0 oz, Sight radius: 5.7 inches. State Department requires the Law Enforcement magazine which holds 13 rounds as opposed to 10 rounds. DS also requires the Trijicon night sights. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304?(2) or 41 U.S.C. 253?(2). The regulatory authority is FAR 6.302-1, Only one responsible source and no other supplies or services will meet the agency?s need.Under the Diplomatic Security and Antiterrorism Act of 1986, the Bureau of Diplomatic Security has a broad range of responsibilities that include the protection of personnel and facilities, both domestic and abroad. Without the weapons requested, the Diplomatic Security Service will be unable to provide the proper level of security and protection. The Sig Sauer P229 9mm pistol is a unique system that our armorers have been certified to repair and the agents have been trained to use. Utilizing a weapon manufactured by another manufacturer can create a legal liability issue. The U.S. Department of State cannot utilize multiple systems for our weapons for the above reasons.The weapons requested are what the agents were trained to use during their initial training as Diplomatic Security Service Special Agent Training. The economic impact to the U.S. Government for using other items than what is requested, would be great and would involve the re-training of all agents in the field including purchasing all new weapons systems to issue to the various mission locations be it overseas or abroad. Sig Sauer is the manufacturer of the P229 Pistol.The DS Firearms Policy and Review Board (FPRB) has approved the use of the Sig Sauer as the ONLY pistol authorized for use by DS Agents. Therefore, no market research was done. The weapons system described above are to be utilized by the agents assigned to overseas posts. The vendor states that the lead time on these items is 90-120 days from the date of order and no other source could provide them in such a timely manner, these items are needed as soon as possible, so it is imperative that this be treated as circumstances permitting other than full and open competition. DS has verified that the request as described represents the government?s minimum requirements.
