Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6 of the Federal Acquisition Regulation (FAR) as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offer(s) is being requested and a written solicitation will NOT be issued. The solicitation number is HSCG29-06-Q-3GE175. This combined synopsis constitutes a solicitation and incorporates provisions and clauses in effect through Federal Acquisition Circular 2001-26. Applicable North American Industry Classification Standard (NAIC) code is 334112, size standard 1,000. The contract will be awarded using simplified acquisition procedures in accordance with FAR 13.5. The acquisition is: Tape Library with one tape drive and eight tape slts, three year express deport expedited warranty service P/N: CY-TLL-0108-L272, quantity: 7 each. NO SPECIFICATIONS DRAWINGS OR SCHEMATICS ARE AVAILABLE FROM THIS AGENCY. NO EQUAL OR ALTERNATE PART NUMBERS SHALL BE ACCEPTED. The following FAR Subpart 12 provisions and clauses are incorporated by reference: 11.104: User of Brand Name or Equal Purchase Descriptions. (a) While the use of performance specifications is preferred to encourage offerors to propose innovative solutions, the use of brand name or equal purchase descriptions may be advantageous under certain circumstances. (b) Brand name or equal purchase descriptions must include, in addition to the brand name, a general description of those salient physical, functional, or performance characteristics of the brand name item that an ?equal? item must meet to be acceptable for award. Use brand name or equal descriptions when the salient characteristics are firm requirements. If the Terms and Conditions (FAR Clauses) incorporated by reference are on the back of this order, they are hereby deleted in their entirety and replaced as follows: 48 CFR 52.232.33 Payment by Electronic Funds Transfer--Central Contractor Registration. The Government Paperwork Elimination Act of 1998 requires that federal agencies provide businesses an electronic business information registration method such as is available through CCR, as an alternative to paper filing. Contractors must be registered in the CCR database if payment is to be made on a contract, purchase order, delivery order, task order, basic agreement, basic ordering agreement, or blanket purchase agreement, except for? a. Comptroller General Examination of record. The contractor agrees to comply with the provisions of this paragraph if this contract was awarded using other than sealed bid, in excess of the simplified acquisitions threshold, and does not contain the clause at 52.215-2, Audit and Records ? The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor?s directly pertinent records involving transactions related to this contract. The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any other shorter period specified in FAR subpart. 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation?s, or claims are finally resolved. As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of form.
