- This is a sole source combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are not being requested and a written solicitation will not be issued. This solicititation is being issued by Washington Headquarters Services Acquisition and Procurement Office (WHS A&PO), Washington DC. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular. The WHS A&PO intends to issue a sole-source purchase order under the Simplified Acquisition Procedures. The acquisition is intended to provide for an upgrade to the existing Siemens Energy Management System PCs and the existing Siemens Apogee 3.3 graphical user interface software with the current revision of 3.7. The Siemens Building Technologies System 600 is currently installed within the Hybla Valley Federal Office Building. This system controls the air handling and chilled/ hot water systems. The Siemens Building Technology System 600 Communicates on a proprietary network using proprietary software and hardware. The hardware and software for the system 600 is manufactured and distributed only by Siemens Building Technologies. The local branch in Beltsville, Maryland as well as 60+ locations nationwide is factory owned and operated. Siemens Building Technologies is the only organization to offer factory training on this system. Other service organizations do not have access to the software or hardware manufactured by Siemens Building Technologies and therefore are uniquely qualified. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This combined synopsis/solicitation is not a request for competitive proposals; however the Government will consider all proposals received within 3 business days after date of publication of this synopsis. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The provision at 52.212-1, Instructions to Offerors- Commercial applies to this acquisition. Offerors should include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications for Commercial Items, with its offer. The clause at 52.212-4, Contract Terms and Conditions for Commercial Items, applies to this acquisition and should also be included. The NAICS code 541513 applies to this solicitation. This is not a Request for Quotation, nor is it an announcement of a forthcoming solicitation. Requests for copies of a solicitation will not be honored. All timely responses will be considered solely for the purpose of determining whether or not it is advantageous to the Government to conduct a competitive procurement; no award will be made on the basis of any response to this notice. A determination by the Government not to compete this proposed purchase order based upon the responses to this notice is solely within the discretion of the Government.
