Description
FA860406R7568 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Proposals are being requested and a written solicitation will not be issued. The Request for Quotation (RFQ) number is FA8604-06-R-7566. This solicitation and incorporated clauses/provisions are those in effect through Federal Acquisition Circular Fac 2005-12, Effective 04 Aug 2006 & Class Deviation 2005-o0001and DFARS Current to Change Notice 20060908. The solicitation incorporates by reference the following clauses: FAR 52.204-7, 52.212-1, 52.212-3, 52.212-4, 52.212-5, and DFARS 252.204-7004 - Alternate A, 252.212-7001, 252.227-7013, and 252.227-7014. NAICS Code: 423430. The below clause is included in full text: AF 5352.201-9101 OMBUDSMAN (AUG 2005) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). ATTACH: BRAND NAME JUSTIFICATION for MATLAB Brand Name Justification for MatLab 1. AFRL/VA has a requirement far additional concurrent licenses of MathWorks MatLab and associated MatLab toolboxes. The MatLab Engineering Support Software Package will include re-instatement, maintenance. technical suppart. upgrades and software documentation. This memorandum identifies the MatLab requirement, as well as the unique characteristics that necessitate the purchase oE MatLab per EAR 8.405- 7(a) ( 4 ) (iii), FAR 11.104 and 11.105. 2, This procurement is a sole source requirement IAW FAR 6.302-1 to The Mathworks. Inc. of Natick, MA. The MathWorks, Inc of Natick MA, is the only known source that can satisfy the government's requirements in accordance with FAR 6.302-1 "Only one responsible source and no other supplies or services can satisfy agency requirements." MathWorks Inc is the designer, developer, manufacturer, and the only seller of MatLab engineering suitc of tools that can provide the technical support, upgrades and documentatlon required by the government. 3. The MathWorks MatLab software package and its related toolboxes provide a collection of proven and efficient numerical methods for solving wide-ranging problems in mathematics, science, and engineering. For example, the MatLab program together with the Simulink toolbox has proven itself especially useful for modeling control systems. Researchers in AFRL/VA also use MatLab to solve optimization problems in fields such as morphing technologies. In a broader sense, HatLab serves as a mathematical sandbox within which new ideas can be quickly explored and matured. 4. HatLab is an essential tool for the scientists and engineers (ShEsi in AFRL/VA. Without access to MatLab and MatLab toolboxes, researchers in AFRL/VA would need to develop and maintain software tailored to specific problems of interest. This would be extremely costly and labor-intensive. Furthermore, because MatLab is widely used in academia and industry, access to MatLab is required to collaborate with outside organizations. 5. Market research has been done to examine the alternatives to MatLab. There are very few software packages available that are even similar to MatLab, and none of these provide the specialized capability of MatLab. In addition to the capabilities of the basic software, HatLab is unique in the highly specialized tools provided through its toolboxes. VA will continue to monitor the market to determine the existence of other potential sources to meet future similar procurement requirements. 6. This procurement will not be synopsized in accordance with FAR 5.Nf.3) (11).
