Description
FA860406R7566 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Proposals are being requested and a written solicitation will not be issued. The Request for Quotation (RFQ) number is FA8604-06-R-7566. This solicitation and incorporated clauses/provisions are those in effect through Federal Acquisition Circular Fac 2005-12, Effective 04 Aug 2006 & Class Deviation 2005-o0001and DFARS Current to Change Notice 20060908. The solicitation incorporates by reference the following clauses: FAR 52.204-7, 52.212-1, 52.212-3, 52.212-4, 52.212-5, and DFARS 252.204-7004 - Alternate A, 252.212-7001, 252.227-7013, and 252.227-7014. NAICS Code: 423430. The below clause is included in full text: AF 5352.201-9101 OMBUDSMAN (AUG 2005) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (d) The ombudsman has no authority to render a decision that binds the agency. (e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer. This is a sole source requirement IAW FAR 6.302-1 to Innovation Associates, Johnson City, NY, is the only designer, developer, manufacturer, and supplier of the items in the attachment and below that meets the Government?s requirement. ATTACH 1: J&A for Sole Source JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. This service is required to ensure patient care/safety is not compromised using the PharmASSIST system. This proposed upgrade to the existing system hardware to add additional storage space and to convert to an XP compatible system from the existing Win2K system will eliminate future system failure due to lack of storage space. It will also prevent loss of service due to AFMC?s impending requirement to convert all network connected systems to XP based operating systems. The estimated one time cost for these upgrades is $97,088.00 based on quotes from Innovations (PharmASSIST Enterprise Systems). 2. The PharmASSIST Enterprise System (PAES) is a patented proprietary system consisting of software, and mechanical devices. This equipment is absolutely necessary for patient safety in regards to medication dispensing , without which we would be incapable of guaranteeing a safe product. In conjunction with FAR 6.302-1(b)(1)(i) ?Only one responsible source and no other supplies or services will satisfy agency requirements.? The proposed vendor is the only vendor able to provide proprietary support for the PharmASSIST system and as such is the only known source able to satisfy this requirement. The Medical Information Systems Office maintains a constant review of new technologies and capabilities as published in medical computer trade journals. Should any other vendor in the future provide services and parts that meet 88th Medical Group requirements, their services will be solicited through normal contracting procedures. 5.
