Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation proposals are being requested and a written solicitation will not be issued. The solicitation number is HSCG23-06-R-DNQ140. This solicitation is issued as a request for proposal (RFP) under NIASC code 334220 on a full and open basis. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2006-07. The U.S. Coast Guard has a requirement to acquire wireless communications systems for crewmembers of 47-foot motor lifeboats and other boat platforms. The contractor will be responsible for a system capable of providing crewmembers with the capability to communicate with one another during all aspects of missions assigned to these platforms as identified in the specification to be provided herein. The capability for all crewmembers shall be clear, unimpeded normal conversational voice communication to land based stations; operational commanders; other boats; ships; and aircraft that may be encountered in the performance of assigned missions in accordance with the attached Requirements Document. An Indefinite Delivery-Indefinite Quantity (IDIQ) type contract with Firm-Fixed Priced task orders is anticipated. The period of performance will be five (5) years from date of award with the delivery terms identified in each order. It is anticipated that the Government will order at least half of the boat sets for the MLB platform within the first year and the remaining in the second year. It is anticipated that all other platform systems and components will be ordered evenly throughout the ordering period, all dependant upon funding received to support the effort. The Government will issue no paper copies. The contractor shall deliver the items in accordance with the applicable terms and conditions. Inspection shall be in accordance with FAR 52.212-4(a). Packing and packaging shall be in accordance with commercial practice to assure delivery at destination. Provision 52.212-1, Instructions to Offerors — Commercial, applies to this acquisition. Offerors shall read and follow the directions given in provision 52.212-1, particularly the submission of past performance information pursuant to 52.212-1(b) (10). The Government will award a single contract to the responsible offeror whose offer, conforming to the solicitation requirements, offering the best value to the Government. The provision at 52.212-2 Evaluation – Commercial Items, applies to this acquisition. The fill-in for paragraph (a) of the provision is as follows: (i) Technical acceptability of the item offered to meet the Government requirement; (ii) Value added features (i.e. warranties, accelerated delivery, etc); (iii) Relevant Past Performance; and (iv) Price. The Government reserves that right to consider any value added factors. These evaluation factors are listed in descending order of importance. When considering all factors, technical acceptability and value added features, when combined, are significantly more important than price and relevant past performance, when combined. Offerors are required to submit at least 3 relevant past performance references. Current, accurate, complete information MUST be provided to contact each reference. This should include contract number, point of contact, phone number and email address for each contact. A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Offerors shall include a completed copy of provision 52.212-3, Offeror Representations and Certification --Commercial Items, with their proposal. Clause 52.212-4, Contract Terms and Conditions -- Commercial Items, is incorporated by reference into the solicitation. The clause 52.212-5, Alternate I, Contract Terms and Conditions Required to Implement Statutes or Executive Orders – Commercial Items applies to this acquisition to include: 52.203-6, Alternate I, Restrictions on Subcontractor Sales to the Government, with Alternate I; 52.204-6 Data Universal Numbering System (DUNS) Number; 52.204-7 Central Contractor Registration; 52.216-18, Ordering; The fill-in for paragraph (a) of this clause is as follows: “date of award through five years from date of award” 52.216-19, Order Limitations, The fill-in for paragraph (a) of this clause is as follows: “ less than $450,000.00”; The fill-in for paragraph (b)(1) of this clause is as follows: “$2,000,000.00”; The fill-in for paragraph (b)(2) of this clause is as follows: “$4,545,000.00”; The fill-in for paragraph (b)(3) of this clause is as follows: “within 15 days” The fill-in for paragraph (d) of this clause is as follows: “within 5 days”; 52.216-22, Indefinite Quantity; The fill-in for paragraph (a) of the clause is as follows: “six months after the expiration of the ordering period”; 52.222-18, Certification Regarding Knowledge of Child Labor for Listed End Products; 52.222-19, Child Labor – Cooperation with Authorities and Remedies; 52.225-1, Buy American Act – Supplies; 52.225-2, Buy American Act Certificate; 52.225-13, Restrictions on Certain Foreign Purchases; and 52.232-33, Payment by electronic Funds Transfer – Central Contractor Registration; 52.233-4, Applicable Law for Breach of Contract Claim. Homeland Security Acquisition Regulation (48 CFR Chapter 30) Clauses (HSAR) – 3052.209-70, Prohibition on Contracts with Corporate Expatriates; 3052.242-72, Contracting Officer’s Technical Representative. There are no addenda to any of the above clauses or provisions. Proposals are due no later than 2:00 p.m. on 30 May 2006. Each offer should price out a complete boat set for the communications system for the Motor Lifeboat and other platforms, as well as each component of those systems separately, so the Government can purchase each piece individually for replacement or sparing as needed. The U.S. Coast Guard will make a 47 foot Motor Lifeboat available for interested parties to visit fifteen days after the release of this solicitation. To further this policy, the Commandant has created the position of Solicitation Ombudsman who is empowered to investigate issues raised by prospective offerors and resolve them, where possible, without expensive and time-consuming litigation.
