- This is a combined synopsis/solicitation in accordance with FAR Part 12. No other solicitation will be issued; proposals are being requested via this notice. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) requires the publication of legal advertisements for the purpose of announcing property seizures. ATF is mandated by law to publish all property that is seized for forfeiture. This has been further defined by the Asset Forfeiture Law and Practice Manual as, ?Notice of the seizure of property and the intent to forfeit must be published once a week for three successive weeks in a newspaper of general circulation in the judicial district in which the proceeding is brought.? In addition, it has been determined this requirement can be met by publication in a national newspaper that meets certain circulation requirements. ATF is mandated by Congress to publish all administrative seizures in a newspaper of general circulation in all 92 judicial districts of the United States and its territories. The advertisement must be published in a newspaper once a week for three consecutive weeks. The purpose of these advertisements is to give notice to all interested parties such as a lien holder or other unknown individuals who may have a vested interest in the property. The contractor shall publish the legal advertisements in a newspaper of general circulation. That is, a newspaper that publishes news of general interest and character to the public, to include political and business events, circulating among the general public in each of the Federal judicial districts of the United States and its territories. The advertisement shall include, at a minimum, specific descriptive information regarding the property and its seizure by ATF. In addition the advertisement will include instructions as to how parties with an interest in the property seized can file a claim to contest the seizure and intended forfeiture of the property. The boundaries of the following Federal judicial districts correspond to the state or territorial boundaries. Therefore, circulation figures for these states or territories will demonstrate circulation for the judicial district: Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, District of Columbia, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Puerto Rico, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Virgin Islands, Washington, West Virginia, Wisconsin, Wyoming, and Guam. In the following cases, more than one Federal judicial district is located within a state. These judicial districts are given, along with the United States Code (U.S.C.) citation, which lists the counties that comprise the district. The Contractor shall publish the advertisements in a newspaper, which has a circulation of substantial quantities in the judicial districts set forth above. The contractor shall furnish evidence that it publishes a newspaper of general circulation in these judicial districts. Substantial quantities means a minimum total PAID circulation of 2,500 or more copies or it must have at least one newspaper in circulation by subscription per 4,000 people in that judicial district. It DOES NOT include distribution of unsolicited copies. The contractor shall publish the advertisements at least once a week in the newspaper. Other printed media such as periodicals, magazines and books are not acceptable. The contractor shall accept from the ATF, Asset Forfeiture and Seized Property Branch, Five (5) working days prior to publication, the text for ad publication, i.e. Monday submission for next Monday publication. Each advertisement shall be placed in sufficient time in order to be published on a specified date. The advertisements shall be published at (1) week intervals. For each weekly advertisement, new text will be added to the advertisement under the caption FIRST NOTICE, which will be inserted in the advertisement immediately after the introductory paragraph. After the advertisement is run, new additional text will be provided to run under the caption FIRST NOTICE, with the text previously run under the caption FIRST NOTICE, repeated under the caption SECOND NOTICE, and the text run under the caption ?SECOND NOTICE?, repeated under the caption THIRD NOTICE. Text previously run under the caption THIRD NOTICE will be dropped from succeeding advertisements. The Contractor shall be capable of receiving the data that is to be published via electronic transmission from ATF. The preferred method is via Internet e-mail as a Word Attachment. The Contractor shall be capable of receiving the data manually (via fax or by disk) if ATF is unable to transmit data electronically. The Contractor shall provide draft copies of each new weekly advertisement to ATF so the data may be examined for accuracy and layout approved before the actual publication of the advertisement. The Government will inspect services within one (1) day after the date of delivery/performance and will make acceptance or rejection within that one (1) day. Included in the draft should be written the font size used and the cost of the advertisement. The Contractor shall also provide copies of the actual publication of the advertisement so immediate verification of the publication can be made. If errors are made, which is not the fault of the Government, the Contractor will re-publicize, at no additional cost to correct necessary errors. The period of performance for this requirement is January 1, 2007 ? December 31, 2007 and four one-year options. The government highly recommends the contractor to submit invoices electronically to financebranch@atf.gov. The contractor shall also submit a copy to AF&SP Branch, 650 Massachusetts Ave, NW, Techworld 710, Washington, DC 20226. Upon relocation to the new ATF Headquarters, ATF will provide the contractor the new address to submit invoices. All offerors shall have circulation access to all locations above. Offerors not meeting this circulation requirement will be considered non-responsive. Offerors shall submit past experience for the same services required in this notice. Offerors shall submit pricing for 50,000 lines per year. Offerors will be evaluated on their ability to meet the above circulation requirements, past experience, and price. Offerors not providing all of the requirements posted in this notice will be considered NON-RESPONSIVE. The following provisions and clauses are incorporated into this combined synopsis/solicitation by reference and no addenda apply: FAR 52.212-1, Instructions to Offerors-Commercial Items; FAR 212-4, Contract Terms and Conditions-Commercial Items; FAR 212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items.
