Description
PERFORMANCE WORK STATEMENT (Part 1) Dobbins ARB, GA 20 September 2006 1. GENERAL. 1.1. NONPERSONAL SERVICES. The contractor shall provide all required personnel, services, transportation, materials, equipment, and supplies to provide medical reference laboratory services. 1.1.1. Laboratory tests not performed at the Government-owned laboratory may be referred to the Contractor?s commercial laboratory as follows: 1.1.1.1. If the government laboratory cannot or chooses not to perform a given laboratory test, the facility may refer the test to the Contractor. The Government will unilaterally determine current and new tests (future) to be forwarded to the contractor. 1.1.1.2. All tests shall be executed at the contractor?s premises, or within the Contractor's network of laboratories (affiliate or qualified subcontractor). 1.1.1.3. Exhibit A is a list of the estimated tests with estimated volumes that are required under contract. This list is not all-inclusive and is subject to change based on government requirements during the term of the contract. 1.2. CONTRACT PERSONNEL QUALIFICATIONS. The Government shall not exercise any supervision or control over the Contractor employees performing services herein. Such employees shall be accountable solely to the Contractor who, in turn, is responsible to the Government. 1.2.1. The contractor shall determine the appropriate number of laboratory, administrative, and support personnel necessary to execute the volume and type of testing required during the term of the contract. Any required increases in staff levels shall be at no increase in cost to the government. 1.2.1.1. The Contractor shall ensure that employees providing customer services under this contract are able to read, write, and speak English fluently, with sufficient clarity, in order to effectively communicate with any government/non-government personnel when necessary. 1.2.2. The Contractor employees shall have the ability to perform the applicable duties consistent with their license and certification. All Contractor employees shall comply with applicable state regulations regarding their certification or registry, or license for the state in which the Contractor?s testing facility is located. 1.2.3. The Contractor shall ensure that all testing and supervisory personnel (at all contractor owned, affiliated, or subcontracted laboratories), including the Medical Director, assigned to work under this contract meet and maintain the applicable personnel qualifications set forth under the Clinical Laboratory Improvement Amendments of 1988 (CLIA) regulations and the College of American Pathology (CAP) accreditation standards. The government reserves the right to request documentation attesting to compliance with the aforementioned requirements for any testing and supervisory personnel at either the contractor?s or subcontractor?s laboratory providing service under this contract. Requests for documentation of personnel at a specific laboratory shall be requested through the prime contractor. The contractor shall submit the requested documentation/certification(s) within seven (7) work days of the POC?s request . Within 21 calendar days of award, the contractor shall forward a listing of all laboratories that might provide medical reference laboratory services. The listing shall include the name of the laboratory, address, POC, and phone number. Updates shall be forwarded to the POC as changes occur. 1.2.3.1. The Contractor shall submit a copy of the professional certification and/or licensure of the corporate Laboratory Director and/or Medical Director to the POC within 10 working days after contract award. Also required are copies of all certifications/licenses for the technical supervisors of the prime contractor?s laboratory. 1.2.4. CONTRACT PERSONNEL. 1.2.4.1. CLIENT SERVICE personnel shall be accessible by toll-free telephone service from 8:00 a.m. to 4:00 p.m., seven (7) days per week to assist Government staff in tracking test results, modifying test requests, obtaining information regarding specimen requirements, requesting emergency courier service, using the provided computer equipment software and/or online systems, and related issues/problems that may arise in the performance of work under this contract. 1.3. CONTRACTOR QUALITY CONTROL PROGRAM . 1.3.1. After commencement of services, the Contractor shall forward any updates to its current Quality Assurance Program to ensure compliance with requirements. Updates shall be forwarded within 15 calendar days of execution to the Contracting Officer. 1.3.2. Every contract laboratory, prime or subcontractor, performing testing under this contract shall hold a current Certification of Accreditation with CLIA, and be accredited to perform laboratory testing by the College of American Pathologists (CAP) in all specialty areas in which testing is performed. 1.3.3. Every contract laboratory, prime or subcontractor, performing drug abuse blood testing under this contract shall be currently certified by the National Institutes of Drug Abuse (NIDA). If the prime contractor does not have NIDA certification and proposes a subcontractor with NIDA certification, the subcontractor shall meet all of the other required certifications and qualifications herein. 1.3.4. The Contractor shall notify the Contracting Officer immediately, in writing, upon its loss (or any of its subcontractors) of any required certification, accreditation, or licensure. 1.4. SAFETY REQUIREMENTS. The Contractor shall maintain: 1.4.1. Safety and health standards consistent with the requirements set forth by the Occupational, Health, and Safety Administration (OSHA), and the Center for Disease Control and Prevention (CDC). 1.4.2. A written property damage report shall be submitted to the Contracting Officer, within 72 hours, for any accident caused by Contractor employees which resulted in damage to Government property. 1.5. SECURITY REQUIREMENTS. 1.5.1. Neither the Contractor, nor any of its employees, shall disclose or cause to be disseminated any information concerning military activity operations. 1.5.2. Neither the Contractor, nor any of its employees, shall disclose private medical information concerning patients to third parties other than those personnel designated by the Government to receive patient results. Results shall be handled as private medical records in accordance with Exhibit B. 1.5.3. All inquiries, comments or complaints, arising from any matter observed, experienced, or discovered as a result of, or in connection with, the performance of this contract shall be directed to the Contracting Officer for resolution. 1.5.4. The Contractor shall only conduct business with designated Government personnel listed as points of contact (POCs). Names of authorized personnel shall be provided to the contractor by the Contracting Officer, in writing, and updated as necessary throughout the contract period.
