Upon request, the Contracting Officer will make their full text available. Also, the full text of a clause may be accessed electronically at this/these address(es): (d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its postacceptance rights-- (1) Within a reasonable period of time after the defect was discovered or should have been discovered; and (2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item. (e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence. (f) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records. The Contractor shall not be paid for any work performed or costs incurred that reasonably could have been avoided. (g) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience. (h) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract. STATEMENT OF WORK: Non-personal services to provide Medical Support Assistant (Health Technician/ Lifestyle Coach) services in the Lawton Service Unit area (includes Lawton Indian Hospital, Anadarko Indian Health Center, and Carnegie Indian Health Center). The Health Technician will be located at the Lawton Indian Hospital Diabetes Prevention Program (DPP) and will work primarily out in the community (within a 60 mile radius) with the DPP participants and prospective participants. The Lawton Service Unit Diabetes Prevention Program (DPP) is a demonstration project to show the success of the NIH funded Diabetes Prevention Program Study results that showed diabetes can be prevented or significantly delayed. The Lawton Service Unit DPP goals and activities are set up to demonstrate that the same program as the study can be implemented successfully by the Indian/Tribal/Urban (I/T/U) programs with the use of the DPP Curriculum (Lifestyle Balance) and DPP program protocols. SCHEDULE OF WORK The work schedule shall not exceed thirty-three (33) hours per week Monday through Saturday and can be adjusted accordingly by the DPP Project Coordinator. The Medical Support Assistant shall be required to work a flexible work schedule that solely depends upon the participant care needs. Hours of operation will vary; the daily tour of duty may as early as 6:00 a.m. and end as late as 9:00 p.m. for a 33 hour work week. Prior approval of the DPP Project Coordinator is required for work on Sunday. Work hours are actual work hours and travel hours are not counted toward work hours. The lunch period is set at one hour and will be taken between 11:00 a.m. and 1:30 p.m. Work on Federal Holidays, Holiday Pay, Sick leave and Annual Leave is not applicable to this contract. Requests for leave shall be submitted in written form in advance, to the DPP Project Coordinator. The DPP Project Coordinator shall be responsible for verifying the approved leave information on the Contractor?s invoice/timesheet. Contractor services shall include, but not be limited to: 1. Establishes close relationships with the participants, assists them with problem solving to be successful in achieving goals set, attending classes, and exercising. 2. Close relationships will be established directly and retention communication can be directly or indirectly by telephone and/or correspondence. Coordinates with the DPP Educators in participant needs, participates in recruitment activities, referrals, retention, and follow-up. 3. Completes annual training online for Security Awareness and HIPAA and provide a certificate of completion to Project Coordinator (www.ihs.gov/AdminMngrResources/HIPAA). CPR certification is required. 4. Completes Providing Dietary Guidance training at Cooper Institute in Dallas, TX to enhance skills for DPP responsibilities with the participants. 5. Attends DPP Team Meetings, classes and trainings as directed by the Project Coordinator, including Lawton Service Unit mandatory trainings. 6. Complies with all policies/procedures of the Lawton Service Unit and follows DPP Operations Manual. 7. Completes all DPP forms pertinent to event/activity as directed by the DPP Coordinator in a timely manner. 8. Assists with planning, participates in and reports on less-intensive activities as well as recruitment activities with the Lawton Service Unit DPP and partners, tribal and community. 9. Reinforces lifestyle education using the DPP curriculum and in coordination with the educators. 10. Work will include community and home visitation. Contractor will be responsible for his or her own transportation when providing community and home visitation because a Government Vehicle is not authorized. The individual can accompany the Diabetes Prevention Program staff as a passenger in the Government Owned Vehicle. 11. Work will include correspondence by mail, fax, email, or office telephone. Government-furnished property will be provided to the contractor to correspond by mail, email, fax or office telephone. QUALIFICATION REQUIREMENTS 1. Education required is a minimum of an Associates Degree and a Bachelors Degree is preferred in a health related area. Coursework must include a minimum of 3 hours in Nutrition and/or health or wellness related coursework. DPP Lifestyle Curriculum training and Coaching Healthy Behavior training will be accepted in lieu of Nutrition for this contract. 2. Contractor must have his/her own reliable transportation. EVALUATION CRITERIA Technical as well as price will be a deciding factor for award of a purchase order. Measurement of possession of the Knowledge, Skills and Abilities (KSA?s) will be accomplished through review of the resume; interview and reference check results. An interview will be required for the top technical offeror or may be conducted with all quoters. THE INDIAN HEALTH SERVICE WILL NOT CONSIDER YOUR QUOTE FOR AWARD IF YOU FAIL TO RESPOND TO THESE EVALUATION CRITERIA AS FOLLOWS: A. Provide an updated resume; B. Provide 3 letters of reference from past supervisors (supervisor telephone numbers and/or address must be current); C. Register in the Central Contractor Registration (CCR) database (reference www.ccr.gov.) D. Propose and provide an all inclusive hourly rate for services. The estimated quantity is 1,723 hours for a one- year period. The estimated date of award is December 4, 2006. E. Provide verification of Buy Indian certification or Certification of Degree of Indian Blood.
