- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This combined synopsis/solicitation number NTSB-Q-07-0001 is issued as a Request for Quote (RFQ) and includes Amendments from Federal Acquisition Circular (FAC) 2005-13, Effective on September 28, 2006. This is a full and open competitive procurement. All responsible sources may submit a proposal. The National Transportation Safety Board (NTSB) is an independent Federal agency charged by Congress to investigate every civil aviation accident in the United States, most public-use aircraft, and significant accidents in other modes of transportation-railroad, highway, marine, and pipeline - and to issue safety recommendations aimed at preventing future accidents. The NTSB also serves as the "court of appeals" for airmen, mechanics, or mariners whenever the Federal Aviation Administration (FAA) or United States Coast Guard (USCG) takes a certificate action. In support of this mission, the NTSB has a requirement for an online legal research service that contains statutes, case law materials, public records and other legal resources, current news articles, and business information. See the Statement of Work (SOW) attached to the solicitation for more information. The period of performance of this requirement is for one (1) base year with four (4) option years for a total performance period of five (5) years. Any questions regarding the solicitation must be submitted via email to Bryan Moy at bryan.moy@ntsb.gov on or before December 1, 2006 at 4:00 p.m. Eastern Standard Time (EST). If required, an amendment to the RFQ will be issued with answers to the questions. The following FAR provisions and clauses apply to this acquisition: -52.212-1, Instructions to Offerors- Commercial Items. -52.212-2, Evaluation- Commercial Items. This is a best value procurement. Technical and past performance when combined are significantly more important than price. -Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications Commercial Items, with its offer. -52.212-4, Contract Terms and Conditions Commercial Items, applies to this acquisition. -52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition and the following additional FAR clauses cited in the clause are applicable to this acquisition: 52.233-3, Protest after Award, 52.233-4, Applicable Law for Breach of Contract Claim, (1) 52.222-3, Convict Labor, 52.222-21, Prohibition of Segregated Facilities, 52.222-26, Equal Opportunity, 52.222-35, Equal Opportunity for Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans, 52.222-36, Affirmative Action for Workers with Disabilities, 52.222-37, Employment Reports on Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans, 52.225-13, Restrictions on Certain Foreign Purchases, and 52.232-33, Payment by Electronic Funds Transfer-Central Contractor Registration. Additional contract requirement- Offeror's proposals shall be evaluated to determine if they meets the requirements as stated in the SOW. Offerors determined to be in the competitive range must perform a 1-hour live demonstration at NTSB of their online legal research service to demonstrate that their proposal and service meets the requirements as stated in the SOW. During the demonstration, the NTSB shall measure the ease of use of the offeror's service in terms such as the length of time and number of screens required to obtain information. This demonstration is tentatively scheduled for the week of December 11, 2006.
