Description
The Space and Naval Warfare Systems Center, San Diego (SSC San Diego) intends to issue Request for Proposal (RFP) No. N66001-07-R-0011 for the award of a Firm Fixed Price, Multiple Award, Indefinite Delivery Indefinite Quantity (IDIQ) services contract for commercial patent application drafting legal services. This will be a full and open competition. It is currently estimated that the contractor will be responsible for preparing and delivering a maximum of forty (40) patent applications per year for a period of four years. SSC San Diego will then file each patent application with the United States Patent & Trademark Office (USPTO). Specific information relating to source selection requirements is presented below to allow time for bidders to gather the information and documentation described below: 1. Identification of the contractor's organization and its legal entity status. 2. A list of at least three client references, one of which for whom the organization has prepared at least seven patent applications in a twelve month period since 2002. 3. A resume of each patent attorney who will perform services under this contract that details that patent attorney's educational, professional, and work experience. Each patent attorney must be a United States citizen. 4. A written designation of at least one patent attorney as having overall responsibility ("primary patent attorney") for the contractor's performance under the contract. 5. At least three United States patents as exemplars that have issued within the last four years that were personally written and prosecuted by the primary patent attorney. The patent exemplars must be directed to at least three of the following categories of technologies: electronic circuits, computer software, optical processors, signal processing, and electro-mechanical systems. 6. The face sheets of seven U.S. patents other than those provided in response to subparagraph (5) above, that are directed to any of the above- referenced categories of technology that were personally drafted and prosecuted by the primary patent attorney, whereon the identify one or more of such categories of technology are identified by the contractor on each such face sheet; 7. Documentation demonstrating the primary patent attorney's participation in a continuing legal education program within the last five years that was focused on drafting and prosecuting patent applications in light of current decisions from the United States Court of Appeals for the Federal Circuit. 8. Documentation that identifies each patent attorney who will perform services under the contract, each attorney's state of bar admission, whether each patent attorney is a member in good standing in that patent attorney's state bar, each patent attorney's USPTO registration number, and that patent attorney's status within the organization (i.e., partner, associate, of-counsel, employee, etc.). The release date for the solicitation has not been determined. The solicitation and any subsequent amendments resulting from this announcement will be available to interested parties via the SPAWAR E-Commerce Central web site at https://e- commerce.spawar.navy.mil/command/02/acq/navhome.nsf/homepage? readform, under Business Opportunities, SSC SAN DIEGO, "Open Solicitations." The solicitation will only be available electronically at this web site. Hard copies of the solicitation will not be available. It is the responsibility of interested parties to periodically monitor the SPAWAR E-Commerce page for updates and new listings. A bidders mailing list will not be established. Matters posted on the web site are not terms of the solicitation unless the solicitation is written or amended to include such matters.
