- The National Institute of Environmental Health Sciences (NIEHS) intends to negotiate on a sole source basis with Network, Appliance, Inc., 7301 Kit Creek Road, Research Triangle Park, NC 27709, pursuant to 41 U.S.C.253(c)(1)--Only one responsible source and no other supplies or services will satisfy agency requirements. This procurement is for renewal of NetApp Software maintenance for periods as described below. Software maintenance includes software updates and/or new versions of the software, and are only available from the original equipment manufacturer, Network Appliance, Inc. Software maintenance is required as follows: (1) QTY: 1 EA CAT#: CS-S-SSP-NBD-PW, NBD-PARTSDEL-POST WTY AND SWPOST-WARRANTY 12 months beginning 1/2007, SERIAL #1037397; (2) 1 EA CAT#: CS-S-SSP, SW SUBSCRIPTION PLAN-FAS940 POST-WARRANTY 3 months beginning 10/01/2007; (3) QTY: 1 EA CAT#: CS-S-SSP-NBD-PW, NBD-PARTS DEL-POST WTY AND SW POST-WARRANTY 3 months beginning 10/01/2007; (4) QTY: 1 EA CAT#: CS-S-SSP-NBD-PW, NBD -PARTS DEL-POST WTY AND SW POST-WARRANTY 6 months beginning 1/1/2007; and (5) QTY: 1 EA CAT#: CS-S-SSP-NBD-PW, NBD-PARTS DEL-POST WTY AND SW POST-WARRANTY 6 months beginning 1/1/2007. Interested parties may identify their interest and capability. Respond to this requirement by submitting written capabilities/specifications to the Contracting Specialist at the address stated above. This notice of intent is not a request for competitive proposals; however, all responses received within 5 days from the date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete this proposed contract action based upon responses to this notice is solely with the discretion of the Government. Information received will normally be considered for the purpose of determining whether to conduct a competitive procurement. If no affirmative responses are received within 5 days of this notice to determine whether a qualified source is more advantageous to the Government, an order will be placed with Network, Appliance, Inc. The NAICS Code/Size is 511210/$23 M. This purchase is to be processed using Simplified Acquisition Procedures in conjunction with FAR Part 12, Acquisition of Commercial Items and is not expected to exceed the Simplified Acquisition threshold of $100,000.
