- The Lake Tahoe Basin Management Unit anticipates awarding a non-competitive contract to Joe Odon to provide Forest level support to the Department of Justice and OGC Attorneys with information related to the Tahoe City Transit Center Project. On February 24, 2006, a complaint was filed in U.S. Court challenging the Tahoe City Transit Center Project. The Forest Service was named in the litigation. Joe Odon prepared the administrative record in May, 2006. The attorneys are asking the Forest to reply to briefs prior to a motion hearing. Statement of Work, Tahoe Tavern Property Owners Association v. USFS litigation (TTPOA ? Transit Center), Case No: 06-cv-00407-LKK/GGH, Introduction: The Lake Tahoe Basin Management Unit (Forest) has been named a party in a lawsuit related to the Tahoe City Transit Center Project. The administrative record, Statement of Undisputed Facts, arguments and related documents have been filed with the Court. The Forest is being asked by the Office of General Council (OGC) and the Department of Justice (DOJ) to assist in reviewing the record and developing responses to plaintiff?s arguments. Background: On February 24, 2006 a complaint was filled in US District Court (E.D.CA) challenging the Tahoe City Transit Center Project. The Forest Service, Federal Transit Administration and Placer County are named in the litigation. Motion hearing is scheduled March 2, 2007. Scope: The product of this project is support to OGC and DOJ?s defense of this lawsuit including records search and written and verbal consultations. Deadlines: Reply Briefs are due 1/19/2007,Motion Hearing is scheduled for 3/2/2007,Coordination with Placer County, OGC, and FTA continuing. Technical Requirements: Key Considerations:1. Knowledge of litigation requirements of the region. 2. Knowledge of the project and its associated record. Contractor will maintain original documents in the LTBMU files. Provide copies as requested by the Defense team (regional office, FTA, Placer County, OGC, DOJ). Requirements of the contract are met when: 1) DOJ has filed required documents with the court and responded to challenges by Plaintiff and request of the Court. 2) When OGC notifies the LTBMU that no further Forest level participation is needed. It is anticipated that work on this project will be completed by the end of December 2007. If the contractor thinks any timeline will not be met, the Forest contact will be notified at least 5 days prior to the deadline. The Forest will provide a computer and a workstation at the Supervisors Office, printers, and copying to produce documents, telephones and fax services. The Regional Office is available for guidance and to provide technical expertise. Vendor's believing they can meet this requirement must submit written information showing clearly that the individual(s) proposed for accomplishing the work have successful experience and level of expertise to accomplish the support.
