Description

(i) This is a combined synopsis/solicitation for commercial item(s) prepared in accordance with FAR 12.6, as supplemented with additional information included in this notice. The U.S. Army Medical Research Acquisition Activity intends to award a so le source contract to Synthes Corporation, 1690 Russell Road, Paoli, PA 19301-1262, for the following items: Surgical Orthopedic Implants and components to fill existing sets. This announcement constitutes the only solicitation; quotes are not being req uested and a written solicitation will not be issued (oral offers will not be accepted). This announcement constitutes a Notice of Sole Source to Synthes, Inc. Any other offerors responding to this notice must be FDA approved for the manufacture, sale an d distribution of these Synthes products. Offerors must be authorized distributors of Synthes products and provide a letter from Synthes stating the company is an authorized distributor of Synthes products. Responses received from other responsible busin esses prior to 5:00pm Eastern Standard Time on 17 January 2007 will be evaluated. (ii) The Solicitation Number is W81XWH-07-T-0043. This is not a request for competitive quotes. (iii) The solicitation document and incorporated Provisions and Clauses are those in effect through Federal Acquisition Circular (FAC) 2005-04. Technical acc eptability is the ability of the quoter to provide the brand name products requested in the list of required items. (x) Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications- Commercial Items and DFARS 252.212-7000, Offeror Representations and Certifications- Commercial Items, with its offer. (xi) The clause at FAR 52.212-4, Contract Terms and Conditions- Commercial Items, applies to this acquisition. The following addenda have been attached to this provision: None. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 ( c ) (1). The FAR citation implementing this authority is Part 6.302-1 (b) (2) Only One Responsible Source. Reason for Authority Cited: This authority is cited du e to Synthes being the only manufacturer, seller, and distributor of its orthopedic surgical implants. The Food and Drug Administration requires FDA approval for all medical products used invasively. These products are intended for United States citizens abroad. FDA approval is also required for use on troop population. Failure to establish this contract will seriously harm the Government in that it will jeopardize the Army Medical Departments (AMEDD) ability to surgically care for its patients. This sp ecific procurement is for Synthes brand parts only. Synthes is one of several orthopedic implant manufacturers that provide orthopedic implants. However, the use of a specific manufacturers product is a physician decision based upon the patients medica l diagnosis and prognosis, product and clinical e fficacy, and the surgeons expertise using a specific product.
