Description
Due to the ongoing delays being encountered at the Pentagon regarding the current CFT source selection, it has become necessary to contemplate extending the current contracts to allow for continued customer support. Per FAR Clause 52.217-8, the Government has the ability to extend the current contracts up to a total of 6 months past the end of the current ordering period. This should be considered as "official" notice that the Government does intend to invoke this right. Formal modifications will be issued to each current contractor prior to 30 Sep 07, but an exact date for issuance is unknown at this time. Upon issuance of these contract modifications, the revised period of performance will be indicated, but shall not be extended beyond 31 Mar 2008. Under NO circumstances will any new orders be issued after that date. The current contracts do allow for the continued performance of existing orders for a period of up to 120 days beyond the expiration of the ordering period, provided any work cannot be completed by that date. This means the latest possible date work can be performed is 31 Jul 2008 at a maximum. If any work cannot be completed within the 120 days, an extension MAY be processed provided the Government and Contractor can agree to a price and completion date and the result is processed bilaterally. This action will be considered the last resort to finishing a task and will only be utilized on a case by case basis when the requirement justifies it. This will not be abused in a manner to attempt to circumvent use of the new contracts, once awarded.
