- NASA/KSC has a requirement for a FOL-3100 2 watt fiber optic shearography laser system, a closed circuit video monitor for laser shearography test chamber, software upgrade and the installation of these upgrades for the current LTI-9000 system being used at the center. NASA/KSC intends to purchase the items from Laser Technology Inc. without full and open competition as permitted pursuant to FAR 13.106 (b) and 10 U.S.C, 2304 (c) (1) for the acquisition of supplies or services determined to be reasonably available from only one source. Laser Technology Inc. has provided all the shearography equipment owned by NASA at KSC for SOFI inspection and holds all relevant US Patents on Shearography (US patents, 6,717,681(Phase Reversal/Phase Stepping Shearography); 5,257,088 (Portable shearography Systems); 5,094,528; and 5,146,289 (Air Couple Acoustic Vibration Shearography). The proposed upgrades fall under the coverage of these US Patents and Laser Technology Inc. is the only company that can support this without infringement. The Government intends to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 4:30 p.m. local time on February 02, 2007. Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. All responsible sources may submit an offer which shall be considered by the agency. An Ombudsman has been appointed.
