Description

(i) This is a combined synopsis/solicitation for commercial item(s) prepared in accordance with FAR 12.6, as supplemented with additional information included in this notice. The U.S. Army Medical Research Acquisition Activity intends to award a so le source contract to Smith & Nephew, Inc., 1688 Camden Court, Arnold, MD 21012-2547, for the following items: Surgical Orthopedic Implants and components to fill existing sets. This announcement constitutes the only solicitation; quotes are not being r equested and a written solicitation will not be issued (oral offers will not be accepted). Offerors responding to this notice must be FDA approved for the manufacture, sale and distribution of these Smith & Nephew products. Offerors must be authorized di stributors of Smith & Nephew products and provide a letter from Smith & Nephew stating the company is an authorized distributor of Smith & Nephew products. Responses received from other responsible businesses prior to 2:00 pm Eastern Standard Time on 6 Fe bruary 2007 will be evaluated. (ii) The Solicitation Number is W81XWH-07-T-0071. This is not a request for competitive quotes. (iii) The solicitation document and incorporated Provisions and Clauses are those in effect through Federal Acquisition Circular (FAC) 2005-04. (iv) N/A (v) The following is a list of the contract line number and items, quantities, and unit of measure: DESCRIPTION OF SUPPLIES/SERVICES: Surgical Orthopedic Implants and components to fill existing sets. (vii) Date of Delivery: Not later than 15 February 2007. Place of Delivery: DCSP Cross Dock Project, c/o O&M X-Dock Center, 1425A Magellan Road, Hanover, MD 21076. FOB Destination: Hanover, MD. Acceptance: Pirmasens, Germany. Acceptance/Inspection : 7 Days. (viii) The provision at FAR 52.212-1, Instructions to Offerors- Commercial applies to this acquisition. The following addenda have been attached to this provision: None. (ix) The provision at FAR 52.212-2, Evaluation -Commercial Items applies to this acquisition. Offers will be evaluated by the following criteria which are listed in relative order of importance. (1) Technical Acceptability; and (2) Price. Technical acc eptability includes the ability of the quoter to provide the brand name products requested in the list of required items and the required certifications. (x) Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications- Commercial Items and DFARS 252.212-7000, Offeror Representations and Certifications- Commercial Items, with its offer. (xi) The clause at FAR 52.212-4, Contract Terms and Conditions- Commercial Items, applies to this acquisition. The following addenda have been attached to this provision: None. (xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders- Commercial Items (April 2005) and DFARS 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Appl icable to Defense Acquisitions of Commercial Items (January 2005) apply to this acquisition. (xiii) Quoters must be FDA approved for the manufacture, sale and distribution of these products. Offerors must be authorized distributors of Smith & Nephew products and provide a letter from Smith & Nephew stating the company is an authorized distributo r of Smith & Nephew products. (xiv) This acquisition is rated under the Defense Priorities and Allocations System (DPAS) as N/A. (xv) The following notes apply to this announcement: N/A (xvi) Offers are due Not Later Than 5:00pm Eastern Standar d Time on 7 February 2007. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 ( c ) (1). The FAR citation implementing this authority is Part 6.302-1 (b) (2) Only One Responsible Source. Reason for Authority Cited: This authority is cited du e to Smith & Nephew being the only manufacturer, seller, and distributor of its orthopedic surgical implants. The Food and Drug Administration requires FDA approval for all medical products used invasively. These products are intended for United States ci tizens abroad. FDA approval is also required for use on troop population. Failure to establish this contract will seriously harm the Government in that it will jeopardize the Army Medical Departments (AMEDD) ability to surgically care for its patients. This specific procurement is for Smith & Nephew brand parts only. Smith & Nephew is one of several orthopedic implant manufacturers that provide orthopedic implants. However, the use of a specific manufacturers product is a physician decision based upon the patients medical diagnosis and prognosis, product and clinical efficacy, and the surgeons expertise using a specific product.
