- Modification 01 to Combined Synopsis/Solicitation W52H09-07-R-0211 is published in response to an industry inquiry. Modification 1 adds Attachment 010 (DFARS Clauses and Provisions). Offerors must download Attachment 010 from the same website ident ified in the synopsis for previously released attachments. Additionally, Modification 1 provides Government responses to industry inquiries as noted below: Question 1: Does the Buy American Act apply ? Answer: Yes. Question 2: Can the weapons be foreign made? Answer: Only if made in a qualified country IAW DFARS 225.872-1. Question 3: Does the specification ISO 9001-2000 compliant mean there actually must be an ISO certificate or simply a quality control system in place which is equivalent to ISO 9001-2000? Answer: The Government requires that any potential awardee be ISO 9001:2000 compliant. The potential awardee does not need to be registered as ISO 9001:2000 certified. ISO 9001:2000 compliance is determined by the appropriate Defense Contract Management A ctivity (DCMA) during initial proposal evaluation. Question 4: Our company has vast experience in brokering small arms and ammunition to the US Government, is this acceptable in this case so long as our subcontractor (manufacturer) is deemed to be technically acceptable? Answer: The Government will consider a proposal from an offeror whose items offered and overall proposal comply with the terms and conditions of the solicitation as published. Question 5: Can you please explain in greater detail The Government may award one or more contracts (multiple awards) under this synopsis/solicitation based on a trade-off process - how does this process work ? Answer: See FAR 15.101-1. Question 6: What is the required delivery schedule of any contract resulting from this solicitation? Answer: Attachments 006 and 007 outline the Government's delivery requirement. Respondents are expected to provide their most aggressive, but attainable delivery schedule in terms of delivery dates and monthly rate of production. Question 7: What are the possibilities of the 200% option being exercised ? Answer: Unknown. Question 8: Does this contract allow for progress payments? Answer: Since this procurement action is solicited using FAR Part 12, Commercial Items, progress payments are not authorized. Question 9: Are we required to submit past performance with our offer? Answer: No. See Attachment 006, Instructions Conditions and Notices to Offerors, which outlines submission requirements.
