Description
The U.S. Small Business Administration (SBA) is developing an acquisition strategy for its requirement for a Contractor to provide services related to the provision of SBA centralized servicing functions for loans made from the proceeds of sales of Section 503 and 504 debentures guaranteed by the SBA, an independent Federal agency. As part of this process, we are seeking information about small businesses that are capable of providing the services. Please note that this is a market survey for informational purposes only and is not a Solicitation. There is no solicitation document available at this time; no contract will be awarded based on this announcement; and no reimbursement will be made for costs associated with responding to this announcement. All responses must be submitted via e-mail in accordance with the instructions that follow. Pursuant to Sections 503 and 504 of the Small Business Investment Act and Title 13, part 120 of the Code of Federal Regulations, the SBA certifies development companies and guarantees debentures of Certified Development Companies ("CDCs"), the proceeds of which are used to make loans to small business concerns ("SBCs"). Loan payments are due monthly and debenture payments are made on a semi annual basis. The Contractor shall perform payment collection, escrow and paying agent functions for these loans and debentures. (See Sections 13 CFR 120.954 of SBA Regulations.) During the time period covered by this contract the Contractor will: (a) Assume responsibility for possession, security, running, maintaining, modifying and upgrading, as requested by SBA, the system software; (b) Establish and maintain accounts as necessary for the operation of this contract; (c) Furnish SBA, upon request, with timely and current reports on program activity as directed by SBA and which may be changed from time to time, as the SBA may reasonably require; (d) Receive, examine, process, complete, distribute and secure all documents received in connection therewith, and any other related documents as directed by SBA; (e) Receive proceeds from debenture sales and disburse these funds pursuant to each Servicing Agent Agreement (SBA Form 1506 - http://www.sba.gov/sbaforms/sbaf1506.pdf); (f) Utilize the Automated Clearing House (ACH) to collect payments from SBCs' bank accounts; (g) Receive monthly payments from the borrowers of the 503 and 504 loans, and distribute or invest funds pursuant to instructions from SBA; (h) Provide as part of the System a web-based transcript access for the CDCs to review and download the loan and debenture status of their portfolio. (i) Make semi annual debenture payments to SBA for 503 loans and to a specified trustee for 504 loans; (j) Make appropriate payments to CDCs, SBA, and other parties involved in the 504 program or as designated by SBA; (k) Communicate with CDCs, SBA, and other parties involved in the 504 program or as designated by SBA; (l) Assume servicing responsibility for the existing portfolio of 503 and 504 loans. (m) Comply with any and all applicable Federal laws and regulations, including without limitation, IRS reporting requirements, and the laws and regulations relating to any relevant Treasury Department requirements, including the Treasury Financial Manual (TFM - http://www.fms.treas.gov/TFM/); (n) Make the information systems accessible through secured data communication links recommended by SBA; (o) In addition to the System, the Contractor will, at its sole expense, furnish all space, equipment and personnel necessary for the operation of the System and for carrying out the tasks of this contract; (p) Comply with the Miscellaneous Receipts Act, and the regulations and guidance issued by the Department of Treasury. The application NAICS code is 522320, with a small business size standard of $6.5 million. Responses to this announcement must provide detailed, concise information about the company?s qualifications and experience in support services similar to those described herein, within the past five (5) years. Information regarding experience shall include the contract number, dollar value, period of performance, current status, and current point of contact information including name, address, telephone number, and e-mail address. In addition, the response must state small business size status (small; 8(a); small disadvantaged; HUBZone, service disabled, veteran owned, etc.) and not exceed five (5) pages. All responses must be submitted electronically to maria.manga@sba.gov and be received no later than March 20, 2007.
