Description
The United States Marine Corps, Marine Corps Systems Command (MCSC), PG-13 Infantry Weapons Systems (IWS) Non-Lethal Systems (ONS) intends to procure on a sole source basis with award of a sole source Firm Fixed Price contract to LE Systems, Inc., 79 George St., East Hartford, CT 06108, for refurbishment and upgrade of 28 Compact High Power (CHP) Laser Dazzlers?. The NAICS Code for this item is 333314 and the Size Standard is 500 employees. The reason justifying other than full and open competition is that LE Systems, Inc., has the proprietary rights to the systems and can provide the required service to the systems. Under the authority of U.S.C. Title 10 2304(d)(1)(b)(i) Contracts competition requirements and pursuant to FAR 6.302.1, in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, or the continued provision of highly specialized services, such property or services may be deemed to be available only from the original source and may be procured through procedures other than competitive procedures when it is likely that award to a source other than the original source would result in substantial duplication of cost to the United States which is not expected to be recovered through competition. LE Systems, Inc., is the original equipment manufacturer and the vendor of the CHP Laser Dazzler? that can provide the required service, which best meets the Government?s needs and current mission requirements. It is essential that the Government uses the original equipment manufacturer to refurbish and upgrade the systems as needed. LE Systems, Inc., has the proprietary rights to the systems and can provide the required service to the systems. LE Systems, Inc., is the only source that can meet the Government's requirement.
