- The Regional Contracting Department, Fleet and Industrial Supply Center (FISC), Pearl Harbor Hawaii intends to negotiate an unrestricted, sole source contract with US Ecology Washington, Inc. utilizing FAR Part 13.106-1(b)(1). Award will be conducted under the provisions of FAR Part 12 Commercial Item and FAR Part 13.5 Simplified Acquisition Procedures. The prospective contractor must be registered in the Central Contractor Registration (CCR). This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. The RFQ number is N00604-07-T-0187. This solicitation documents and incorporates provisions and clauses in effect through FAC 2005-15 and DFARS Change Notice 20070212. It is the contrac tor?s responsibility to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text as these addresses: www.acqnet.gov/far and http://www.acq.osd.mil/dpap/dfars/index.htm. The NAICS Code is 562211 and the Small Business Standard is $11.5M. All prospective quoters are responsible for monitoring this site for the release of amendments (if any) or other information pertaining to this solicitation. The Regional Contracting Department, Fleet and Industrial Supply Center (FISC) Pearl Harbor, Hawaii requests responses from qualified sources for the following: (a) Provide services of unloading and burying 204.64 cubic feet of radioactive material in compliance with the applicable Federal, State and local regulations. Pearl Harbor Naval Shipyard, under a separate contract, will transport the radioactive material to the burial site as defined by individual purchase orders. Prior to shipment, a purchase order will be issued to the contractor which defines the quantity, type, size, weight, etc. of the radioactive material designated for shipment. (b) Any further reference to radioactive material herein will be defined as waste products and/or materials. (c) The waste product to be disposed of shall be of the type and quantities as described in Section B of the purchase order. (d) The Government represents and warrants that it has obtained all the necessary permits and approvals from the appropriate regulatory agencies for the shipment and disposal of waste products identified in the purchase order. (e) The Government shall provide to the Contractor a "Radioactive Waste Shipment and Disposal Manifest" or any authorized manifest as required by NRC (Nuclear Regulatory Commission) which will be properly executed by the Government and provided with each shipment. The Government represents and warrants that data set forth in the radioactive waste shipment and disposal manifest is true and correct in all respects and is in accordance with all applicable government laws, rules and regulations. (f) The Contractor shall rely on any and all representations set forth in the manifest document. Should the Government learn of any variance in the composition and/or work quantity of the shipment after issuance of the purchase order, the Government shall notify the Contractor of the variance via a modification to the purchase order stating the variance and adjusting the cost of the purchase order in accordance with the scheduled rates (pricing) set forth. (g) The Contractor shall retain the sole right to reject any and/or all the materials constituting such a variance not previously covered on the purchase order. (Note: variance is defined as the kind of packages and work quantity is defined as the number or each kind of package). (h) Waste products are defined as radioactive waste materials described, identified, marked, and labeled in accordance with applicable Federal, State and local regulations and which are acceptable for receipt and disposal under licenses issued by the appropriate agency to the Contractor. (i) All materials shall be furnished to the Contractor in non-returnable containers, with the exception of the outer shipping casks and integral trailer conveyance used for the resin catch tank shipments. The Governme nt will be responsible for the arrangement of transportation of the re turnable containers. Applicable Licenses/Permits: Offeror must have and shall submit a copy of applicable licenses/permits issued by the Nuclear Regulatory Commission or the governing state and a copy of the Waste Acceptance Criteria (WAC). Low-Level Radioactive Waste Disposal Facility must be able to accept Class A through C radioactive low level waste and must be located in the Northwest Compact. Period of Performance is 04 Apr ? 16 Apr 2007. Clin 0001: Volume: Per cubic foot: 204.64 Cubic feet; Clin 0002: Shipment: Per manifested Shipment 1 each; Clin 0003 Containers for manifested shipments: 2 each; Clin 0004 Exposure: Dose rate per container 2 each; Clin 0005 PC & M fee 204.64 cubic feet. Clin 0006 Business and Occupational Tax of Rates and charges, 3.3% of R&C. Clin 0007 Site Survelliance Fee: 204.64 cubic feet; Clin 0008 RCW Surcharge 204.64 cubic feet; Clin 0009 Commission of Regulatory Fee of Rates 1% of R&C, 1 each. Contractor must be registered in the Central Contractor Registration Database (CCR) to be eligible for Department of Defense Contract awards. REVIEW OF AGENCY PROTEST (FISCPH) (NOV 2004) (a) The contracting activity, Fleet and Industrial Supply Center, Pearl Harbor (FISCPH), will process agency protest in accordance with the requirements set forth in FAR 33.103 (d). (b) Pursuant to FAR 33.103 (d)(4), agency protests may be filed directly with the appropriate Reviewing Authority or a protester may appeal a decision rendered by a Contracting Officer to the Reviewing Authority.
