Description
The US Army Corps of Engineers seeks to award a commercial contract to provide the Security Guard Services at the Albany Field Office (AFO) Reservation, 1 Bond Street, Troy, New York. The facility consists of 13 buildings of various sizes, a navigat ion lock, and approximately 7 acres of land bounded by a security fence on the northern, eastern, and southern perimeter, and by the Hudson River on the western perimeter. A layout of the facility, including the location and numbering of buildings, is inc luded at Appendix C. Approximately 30 civilian employees work at the facility, however, during the period of contract services, the facility will normally be unoccupied. The contractor shall be licensed in the State of New York and shall comply with a ll State and local laws applicable to security guards. Where required by local law or ordinance, prior to the commencement of work the Contractor shall obtain and furnish copies of any licenses, permits, etc. for the Contactor and for each employee servin g as an unarmed security guard. The Contractor shall furnish trained personnel, uniforms, equipment, material, and supervision (with the exception of Government-furnished facilities, equipment and materials specified herein) to satisfactorily maintain the physical security of the AFO facility. Services performed under this contract shall be subject to inspection and acceptance by the Contracting Officer or his duly authorized representative (COR). The Contractor shall endeavor to prevent the occurrence of fires, explosions and other catastrophes by close observation of the buildings, machinery, vehicles, electrical equipment, and personnel to identify unsafe or potentially unsafe conditions, procedu res or activities. Upon the citing of any unsafe condition, the COR or his designee shall be notified and admission to the unsafe area shall be restricted. Only authorized personnel shall be allowed admittance to the restricted area in order to minimize the risk. representative to serve as a local supervisor and local point of contact for operational issues on a 24-hour basis. (Note: If the Contractor is based within 50 miles of the AFO, the Contract Manager may serve as the Local Supervisor.) The local supervis or shall conduct random unannounced site visits no less than twice monthly to review the performance of the guards assigned to this contract to insure compliance with contract requirements. The local supervisor shall submit a report of findings to the Chi ef, Albany Field Office within two days of the unannounced visit noting any observations, deficiencies and proposed corrective actions. The local supervisor shall have authority to assign alternate guards in the case of unscheduled absences of scheduled c ontract guards, to take appropriate immediate action if assigned guards are unable to complete their tours, and to implement immediate corrective actions for contract deficiencies. Level of Supervision. As a minimum, the Contractor shall provide a level of supervision necessary to ensure contract guards: Are properly trained to perform all duties specified and meet the minimum qualifications of personnel included in this specification. Are properly uniformed and present a neat appearance. Possess all necessary permits, authority, and licenses. Are physically qualified to meet the physical demands of the job. Fully understand their responsibilities and all contract requirements. QUALIFICATIONS OF PERSONNEL. To be eligible to perform under this contr act each contract employee must meet the following age, education/experience, medical and security requirements: Age. All contract employees shall be minimum of twenty-one years of age (age requirement may be waived by the Contracting Officer for veteran s of military service and for active duty military personnel). Education/Experience. Contract guards must possess a high school diploma or equivalency and have two (2) years of experience demonstrating they have the following abilities: The ability to fluently speak and converse in the English language, understand and apply rules, detailed orders, instructions, and training materials; SPECIAL NOTICE TO ALL BIDDERS. Prohibition Against Contract With Detective Agencies. Federal law as contained in section 3108 of title 5 of the United States code is quoted as follows: An individual employed by the Pinkerton Detective Agency or simil ar organization may not be employed by the Government of the United States or the Government of the District of Columbia. The Comptroller General in his decision B-139965, June 30, 1959 (38 Comp. Gen. 881), held that the above prohibition is applicable t o contracts or agreements with detective agencies or agencies which are of an investigative nature, as well as to contracts with individual employees of such agencies, and that the United States Government may not enter into contracts with detective or inv estigative agencies. In order that award of the contract will not be in violation of the above cited law, the bidder is requested to complete and sign the certification to this effect. Resume of Experience. Bidder shall supply a brief resume of previous and current performance, over a fiveyear period, listing the agencies and companies with whom they have contracted, their addresses, the contract numbers, and the manpower level required for each contract. MINOR CHANGES TO CONTRACT. Minor changes to t he tasks identified in paragraph 14 above required to be performed by the Contactors personnel may be made during the contract. Such changes shall not require a written modification to the basic contract provided the change is within the scope of the bas ic contract and the change does not affect the Contractors man-hours or otherwise affect the Contractors cost for performing the work. DETERMINATION OF CONTRACT. The Government may elect to terminate the Contract at any time during the contract period by providing the Contractor a thirty (30) day written notice of the termination. No additional payment for any adjustment to the contract prices resulting from such termination will be made. PAYMENT. Payment of the contract lump sum amount shall constit ute full compensation for all costs associated with providing security services specified herein including all associated supervision and administration. Equal monthly partial payments (Monthly partial payment = Lump Sum Annual Contract Price /12 months) will be made within 30 days of receipt of a proper invoice from the Contractor for the preceding months services. Upon formal request from the Contractor, the Contracting Officer may authorize a revision to the payment schedule to allow partial payments to be made twice per month (Bimonthly partial payment = Lump Sum Annual Contract Price/ 24 bimonthly payments). The procurement is for five years, a base year plus 4 option periods. This procurement is being solicited as a SMALL BUSINESS SET-ASIDE.
