- The Marine Corps Systems Command intends to award a contract modification on a sole source basis for an additional 453 complete systems and associated spares via modification to contract M67854-07-C-2062. The additional 453 units are an increase to the Approved Acquisition Objective (AAO) to support an Urgent Universal Need Statement (UUNS) for the Target Location, Designation and Hand-Off System (TLDHS) from Stauder Technologies, Inc., 115 Mexico Court, Suite D, St. Peters, MO. 63376. The justification permitting other than full and open competition is 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, ?Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.? A Firm-Fixed-Price (FFP) contract modification is anticipated. The total estimated cost of this acquisition is $15,000,000. The Period of Performance is 13 months from issuance of modification until final delivery. On 11 April 2006, an MROC Decision Memorandum 23-200 6 was released approving the Excalibur Unitary GPS Precision Guided Munitions (PGM) and I MEF TACP Suites for FACS and JTACS. The TLDHS is the USMC solution to TACP/FO Suites. The TLDHS is the forward observer?s (FO) entry device into AFTADS for requesting Excalibur missions. The fielding for the M-777A2 155-mm howitzer with Excalibur munitions is scheduled for 3rd quarter FY07. Stauder Technologies has developed and implemented unique algorithms in their software package. This development has resulted in an original system whose function cannot be duplicated by any existing package or by a modification to any existing package. The Government does not have the source code for TLDHS and therefore cannot provide it with a solicitation. As a result of Stauder Technologies? extensive experience, any competition would result in unrecoverable, extensive duplication of cost. Moreover, award of the TLDHS effort to any other source would result in unacceptable delays in fulf illing the agency?s urgent requirements and could upset the present pr ogram schedule by introducing unknown variables and schedule risk. Based on the years taken to develop this capability to date, it is not expected that another source could step in, replicate the capability, test and field and remain on track to sustain. Currently the Government does not have a technical data package which includes software. No request for proposal is available for competitive bidding. However, interested parties are encouraged to submit a statement of capability for satisfying this requirement. All communications shall be in writing. Proprietary information shall be clearly identified as such and will be protected.? See numbered note 22.
