Description
This is a combined/solicitation for a firm fixed priced, commercial item contract prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a proposal is being requested and a written solicitation will not be issued. The Government intends to procure from Gyrocam Systems, LLC that company?s Gyrocam TS Triple Sensor Surveillance System. The Government intends to negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. All proposals received within ten days after the date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete the proposed contract, based on responses to this notice, is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Solicitation No. DJMS-07-Q-0014 is issued as a request for proposals. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-16. This procurement is sole source. The contract line item is CLIN 0001, Gyrocam TS Triple Sensor, model GC/TS (1 each). The description of the item to be procured is: 4 axis gimbal; Thermal imager (3 to 5 micron); 17mm, 60mm 200mm optical zoom; 800 Line 3 chip color camera, 36 to 1368 mm optical extender (color zoom); built in GPS with on-screen display; interface unit; remote hand controller; customized aircraft cable kit; complete set of storage cases; two (2) year warranty and one week of training is required. Installation, demonstration and training are to be included within the price of CLIN 0001. Any procured Infrared Dual Sensor must be compatible with the previously installed Gyrocam Aircraft Quickswap Mount, which is attached to the left aft fuselage of a Cessna aircraft, and conform to applicable FAA requirements for weight and balance. Delivery is required not more than 100 days after receipt of aircraft at the contractor?s facility (FOB: Origin). Acceptance will be at the contractor?s facility, following installation, by the contractor of the Triple Sensor on the USMS aircraft. Also, a test flight should be performed prior to USMS acceptance. At the time of award, the Contracting Officer will appoint a representative to take delivery on behalf of the Government. Training for the surveillance system operation shall occur at a CONUS location and will be specified by the agency when required. The provisions at 52.212-1, Instructions to Offeror-Commercial, apply to this acquisition. Proposals must include a completed copy of the provision at 52.212-3, Offeror Representatives and Certifications-Commercial Items. The clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition and there are no addenda to the clause. The clause at 52.212-5, Contract terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. The following FAR clauses of 52.212-5(b) apply: 52.203-6, Restrictions on Subcontractor Sales to the Government (Jul 1995), with Alternate I (Oct 1995); 52.222-3, Convict Labor (Jun 2003); 52.222-19, Child Labor-Cooperation with Authorities and Remedies (Jan 2004);52.222-21, Prohibition of Segregated Facilities (Feb 1999); 52.222-26, Equal Opportunity Act (Apr 2002); 52.222-35, Equal Opportunity for Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans (Dec 2001):52.222-36, Affirmative Action for Workers with Disabilities (Jun 1998); 52.222-37, Employment Reports on Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans (Dec 2001); 52.225-1, Buy American Act-Supplies (Jun 2003);52.225-13, Restrictions on Certain Foreign Purchases (Dec 2003);52.232-33, Payment by Electronic Funds Transfer-Central Contractor Registration. CLASS JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following Justification, the class of procurements described below should be issued other than full and open competition, pursuant to the authority cited herein. JUSTIFICATION 1. Contracting Office: This class justification and approval is prepared by the Headquarters Procurement Team, U.S. Marshals (USMS). 2. Nature of the Action: Class justification and approval for other than full and open competition under FAR 6.302-1, only one responsible source and no other supplies and services will satisfy agency requirements. 3. Description of Supplies Services: The equipment required is one Gyro-Cam TS Triple Sensor. The estimated price is $260,000.00. 4. Statutory Authority: Appropriate statutory authority permitting other than full and open competition is 41 U.S.C. 253 ? (1). 5. Rationale Supporting Use of Authority Cited Above: A fully functional Infrared Dual Sensor and zoom capable camera system are instrumental in helping the USMS complete its mission of air surveillance. The Gyro-Cam Systems Dual Sensor Camera, which is in use on all USMS Cessna 206 aircraft, has proven adequate in meeting the USMS needs. The Gyro-Cam System is the only system that is compatible with previously installed mounting and operating systems onboard the USMS Cessna 206 aircrafts. 6. Efforts to solicit potential sources: A sole source combined synopsis/solicitation will be issued on FEDBIZOPPS. The contracting office/requesting office will evaluate all responses received. 7. Determination of Fair and Reasonable Prices: The contractor has submitted data that the system to be procured has been sold in substantial quantities to Federal, State and local government entities. A price comparison will be performed between the current submitted price of their Gyro-Cam system and that of past prices offered to the USMS and other governmental/ non-governmental entities, for both identical and similar items. 8. Market Survey: Recent procurements for the Infrared Dual sensor have been sole source to Gyrocam Systems. This is because market research has shown that the Gyro-Cam System is the only system that fits the external camera mounts and operates on the internal operating systems installed on all USMS Cessna 206 aircraft. This has been verified by Richard Hunter, Chief Inspector, TOG, Air Surveillance Branch. Although past market research has indicated that there are several companies producing digital imagery collection systems, these systems are not compatible with the USMS Cessna 206 mounting and operating systems. 9.
