- The Fleet & Industrial Supply Center Jacksonville, Florida intends to negotiate on a sole source basis with FLIR Systems, Inc., Billerica, MA for a service maintenance agreement for Government-owned cameras for a one-year period. The procurement will be processed under the authorities of FAR 6.302 and the test program for commercial items, ?Section 4202 of the Clinger-Cohen Act of 1996.? (Justification & Approval provided herein.) This is not a request for competitive proposals/quotes. However, the Government will consider all proposals/quotes that clearly demonstrate the ability to meet the needs of the Government. A determination by the Government not to compete this proposed contract based on response to this notice is solely within the discretion of the Government. JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION LIMITED SOURCE JUSTIFICATION 1. Contracting Activity. The Fleet and Industrial Supply Center, Jacksonville 2. Description of the Action Being Approved. This is a sole source action to be conducted under the authority of the Test Program for Commercial Items, (Section 4202 of the Clinger-Cohen Act of 1996). This sole source action is to restrict the provider of camera maintenance services for nine (9) Government-owned cameras to FLIR Systems, Inc. the manufacturer of the cameras, due to the proprietary data for this equipment. The manufacturer of the cameras, FLIR Systems, Inc., is located at 25 Esquire Road, North Billerica, MA 01862-2501. The proposed action is a follow-on contract for maintenance services acquired under contract N68836-06-C-0046. A firm-fixed contract is anticipated. 3. Description of Supplies/Services. The proposed acquisition is for general maintenance services for nine (9) Government-owned surveillance cameras utilized by the Security Department at SWFLANT, Kings Bay, Georgia for surveillance of high security areas, to include the grounds surrounding the Nuclear Weapons area. The nine cameras were manufactured by FLIR Systems, Inc. and include the following model and serial numbers: Sentry with Joystick Control and Breakout Box/13520105, 13520106, 13520107, 13520108, 13520186, 13530084, and 13530129; and Ranger cameras/21628, 21631. The camera maintenance services include full functional testing of the camera systems; cleaning and checking the optics and the exterior of each camera; and calibrating the thermal temperature reading models, as required. The service maintenance includes replacement parts and labor for the aforementioned camera models and serial numbers previously purchased through FLIR. The required period of performance is 16 May 2007-15 May 2008. FY 07 O&MN funds shall be used for this procurement. 4. Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority which permits other than full and open competition is 10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements, as implemented by 6.302-1 of the Federal Acquisition Regulation (FAR). 5. Rationale Justifying Use of Cited Statutory Authority. FLIR Systems, Inc. maintains the proprietary data for the cameras, and as such, are the only source with the specifications and technical data that is required to maintain the commercial equipment. FLIR Systems, Inc. will not replace defective parts if a contractor other than FLIR is involved. The proprietary data is not available for purchase by the U.S. Government. 6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. The requiring activity certifies and the Contract Specialist confirmed through market research that the requirement can be met by a commercial item. The requirement will be advertised on the Federal Business Opportunities website. 7. Determination of Fair and Reasonable Cost. The Fleet and Industrial Supply Center (FISC) Jacksonville, Contracting Officer will make a price reasonableness determination. 8. Actions to Remove Barriers to Future Competition. For the reasons set forth in Paragraph 5, FISC Jacksonville has no plans at this time to compete future contacts for the types of supplies covered by this document. If changes in the SWFLANT camera requirements and maintenance provisions allow, FISC Jacksonville will assess whether competition for future requirements is feasible. 9.
