- THIS IS AN INTENT TO SOLE SOURCE ANNOUNCEMENT. This is NOT a solicitation. This is NOT a request for competitive proposals. The U.S. Department of Health and Human Services (HHS), Program Support Center (PSC), Division of Acquisition Management (DAM), working in partnership with Federal Occupational Health Services (FOH), intends to award a sole source Indefinite Delivery /Indefinite Quantity (IDIQ) contract to Brittingham Software Design, Inc. (BSDI), 6 Kellie Ct, Califon, NY 07830-4301, DUNS 94-8793-161. Attached to this Special Notice is the Justification for Other Than Full and Open Competition (JOFOC). This action is being processed in accordance with Federal Acquisition Regulation (FAR) Part 13.5 Simplified Acquisition Procedures. The authority to award sole source contracts in a simplified manner is specified under the Clinger-Cohen Act of 1996, Section 4202 (Public Law 104-106) and FAR 13.501(a). In accordance with FAR 5.2, Synopses of Proposed Contract Actions, potential vendors are being provided a reasonable opportunity respond to the proposed contract action: 30 calendar days from the start of this posting date (i.e. through June 1, 2007). This is NOT a solicitation. This is NOT a request for competitive proposals. All potential vendors, including 8(A), VETERAN-OWNED SMALL BUSINESS, SERVICE-DISABLED VETERAN OWNED SMALL BUSINESS, HUBZONE SMALL BUSINESS, SMALL DISADVANTAGED BUSINESS, AND WOMEN OWNED SMALL BUSINESS that are capable of meeting the Government?s requirement as detailed in the JOFOC must submit in writing an affirmative response demonstrating technical capability. To be considered an affirmative response, all responses must include detailed technical information and other technical literature that addresses each of the JOFOC requirements. The affirmative response must be described in sufficient detail to permit agency analysis to establish a bona fide capability to meet the requirement. Failure to submit documentation will result in the agency proceeding as stated above. All information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. However, a determination by the Government not to compete this action based on this notice is solely within the discretion of the Government.
