- Northern Navajo Medical Center is currently looking for the following nurses to work at our hospital under 13 weeks contract. After the 13 weeks the RN can be extended upon their performance and the need of the department. Contractor Responsibilities: 1. The Contractor shall be responsible for making the necessary arrangements for travel, housing and assuring that all applicable taxes are paid. 2. The rates specified herein are inclusive of all necessary and associated costs, such as travel, per diem, applicable taxes (i.e. federal, state and local) and housing. 3. The contractor shall provide a written statement, to the Contracting Officer (CO) indicating that applicable taxes have been paid. This statement shall be provided within 20 days of tax payment/s. Nonpayment or noncompliance may become formal grounds for termination for default. The Contractor shall be cognizant of the penalties for submission of false or fictitious statement which includes payment of fines or imprisonment as defined in the United States Code, Title 18, Chapter 47, Sec. 1001: Fraud and false statements. http://www.gpoaccess.gov/uscode/ 4. The Contractor is responsible to ensure that all documentations are completed prior to the last day of his/her assignment. Final payment will be processed after the requirements are met. This includes patient charts and other paper work required. 5. The Contractor shall be covered by the ?Federal Tort Claims Act? during the tour of duty providing health care services in the facility owned, operated and constructed under the jurisdiction of the Indian Health Services ad in accordance with Statutory Authority of P.L. 103.322, Personal Services Contract. 6. The Contractor does not receive Health Benefits, Paid Leave, TSP, Educational Funds, Housing, Meals, and Transportation to and from the the job site. C. Timesheet Submission: 1. The Contractor shall submit a valid and accurate timesheet signed and approved by the Department Supervisor or the Acting Supervisor on a bi-weekly basis to Charlene Manuelito, Receiving Agent, General Services Department at Northern Navajo Medical Center. 2. Timesheets shall be submitted within 5 working days upon completion of a government pay period as identified in the attached payroll calendar. (See attachment). NOTE: Biweekly pay period begins on Sunday and ends on the following Saturday. Any hours worked beyond 80 hours (hours worked when in on-call status are excluded) shall be approved by the Director of Nursing and documented accordingly on the timesheet. 3. The timesheets shall contain the following information: a. Contractor?s name, purchase order number, signature and actual days and hours worked. Note: Contractor shall not claim lunch break as actual hours worked. b. The following citation shall be included on each timesheet submitted: ?I hereby certify that this timesheet accurately reflects the actual dates/s and hours worked by __ (Provider?s name)_____. INVOICE SUBMISSION: The Contractor?s original invoice shall be submitted to: NNMC, Attention: Finance Department, P. O. Box 3790, Shiprock, NM 87420. The contractor shall submit only the valid invoices that have been substantiated by valid timesheets. The invoices shall be submitted to the Finance Dept., at NNMC within 5 working days after validation of timesheets. The invoices shall contain the following information: 1. Contractor?s name; purchase order number; invoice number; description of services; unit price/s; actual days and hours worked and total amount. 2. The following citation shall be included on each invoice submitted: ?I hereby certify that this invoice accurately reflects the actual date/s and hours worked. This invoice has been validated against the appropriate timesheet submitted for this pay period.? Fringe Benefits $23.51 ph ____plus 25%_______ Pro-Children Act of 1994 The Contractor certifies that it will comply with the provisions of Public Law 103-227. Pro-Children Act of 1994, which imposes restrictions on smoking where Federally funded children?s services are provided. The Act requires that smoking should be prohibited in any indoor facility or portion of a facility owned, leased, or contracted for use for the routine or regular provision of health care, day care, or early childhood development (Head Start) services to children under the age of 18. Failure to comply with the provisions of the law may result in the imposition of a civil monetary penalty of up to $1,000 per violation and/or the imposition of an administrative compliance order on the responsible entity. By submitting an offer and entering into a contractual agreement with the Government, Contractors certify that they will comply with the requirements of the Act. Contractors must obtain the same certification from subcontractors. Crime Control Act of 1990 Section 21 of the Crime Control Act of 1990, 42 U.S.C. 13042, as amended by section 1094 of Public Law 1-02-190, requires every facility operated by the federal Government (or operated under contract with the Federal Government) that hires (or contracts to hire) individuals involved in the provision of child cares services to assure that all existing and newly hired employees undergo a criminal background check. The term ?child care services? is defined to include health and mental healthcare. The Government will conduct criminal background checks on all healthcare worker?s providing child care services under this contract based on fingerprints of contractor employees obtained by a Government law enforcement officer and inquiries conducted through the Federal Bureau of Investigation (FBI) and state criminal history repositories. Within 30 days after contract award, the Contractor and all contractor employees shall provide all reasonable and necessary assistance to the Government, including compliance with the employment application requirements set for the in 42 U.S.C. 13041(d). Upon receipt of the results of a background check, the Contactor further agrees to undertake a personnel action in accordance with 42 U.S.C. 1304(c.) when appropriate. With written recommendation from the Contracting Officer, and the approval one level above the Contracting Officer, a contractor employee may be permitted to perform work under this contract prior to the completion of the background check, provided the employee is within sight and continuous supervision of an individual with a successful background check. Health Insurance portability and Accountability Act (HIPAA) The Indian Health Service (I.H.S.) is required to comply with the HIPAA in the provision of health care to I.H.S. patients. HIPAA was implemented by the U.S. Department of Health and Human Services, Office of Civil Rights, under the Code of Federal Regulations, Part 160 and 164. Accordingly, all health care providers, including contracted health care providers are required to comply with HIPPPA requirements. (Full text will be furnished upon request.) Supervision Contractors providing services under a Personal Services shall be subject to day-to-day supervision and control by Government personnel. Supervision and control is the process by which the Contractor receives technical guidance, direction, and approval with regard to services with the requirements of this contract.
